77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the notice given by a property owner prohibiting
1010 certain persons from carrying certain firearms on the property.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 30.05, Penal Code, is amended by
1313 amending Subsection (c) and adding Subsection (c-1) to read as
1414 follows:
1515 (c) A person may provide notice that firearms are prohibited
1616 on the property by posting [a sign] at each entrance to the property
1717 [that]:
1818 (1) a sign that:
1919 (A) includes, in both English and Spanish,
2020 language that is identical to or substantially similar to the
2121 following: "Pursuant to Section 30.05, Penal Code (criminal
2222 trespass), a person may not enter this property with a firearm";
2323 (B) [(2) includes the language described by
2424 Subdivision (1) in both English and Spanish;
2525 [(3)] appears in contrasting colors with block letters
2626 at least one-half [one] inch in height; and
2727 (C) [(4)] is displayed in a conspicuous manner
2828 clearly visible to the public; or
2929 (2) a sign that:
3030 (A) includes, in both English and Spanish,
3131 language that is identical to or substantially similar to the
3232 following: "No firearms permitted on this property";
3333 (B) appears on a white background with black
3434 block letters at least one-half inch in height;
3535 (C) contains a pictogram that shows, on a white
3636 background, a handgun drawn in black ink within a red circle of at
3737 least six inches in diameter and a diagonal red line across the
3838 handgun; and
3939 (D) is displayed in a conspicuous manner clearly
4040 visible to the public.
4141 (c-1) Notice provided under Subsection (c) may be combined
4242 in the same sign as notice provided under Section 30.06(c)(3)(B) or
4343 (C) or Section 30.07(c)(3)(B) or (C) by including the applicable
4444 statement for each category of entry to be prohibited. If notice is
4545 given in the manner described by Subsection (c)(2), and combined
4646 with notice described by Section 30.06(c)(3)(C) or Section
4747 30.07(c)(3)(C), it is not necessary to display more than one
4848 pictogram such as that described by Subsection (c)(2)(C) of this
4949 section. Notice provided in the manner authorized by this
5050 subsection is considered to be sufficient for purposes of
5151 prohibiting the categories of entry described by this section,
5252 Section 30.06, and Section 30.07, as applicable.
5353 SECTION 2. Section 30.06(c)(3), Penal Code, is amended to
5454 read as follows:
5555 (3) "Written communication" means:
5656 (A) a card or other document on which is written
5757 language identical to the following: "Pursuant to Section 30.06,
5858 Penal Code (trespass by license holder with a concealed handgun), a
5959 person licensed under Subchapter H, Chapter 411, Government Code
6060 (handgun licensing law), may not enter this property with a
6161 concealed handgun"; [or]
6262 (B) a sign posted on the property that:
6363 (i) includes the language described by
6464 Paragraph (A) in both English and Spanish;
6565 (ii) appears in contrasting colors with
6666 block letters at least one-half [one] inch in height; and
6767 (iii) is displayed in a conspicuous manner
6868 clearly visible to the public; or
6969 (C) a sign posted on the property that:
7070 (i) includes, in both English and Spanish,
7171 language that is identical to or substantially similar to the
7272 following: "No concealed handguns permitted on this property";
7373 (ii) appears on a white background with
7474 black block letters at least one-half inch in height;
7575 (iii) contains a pictogram that shows, on a
7676 white background, a handgun drawn in black ink within a red circle
7777 of at least six inches in diameter and a diagonal red line across
7878 the handgun; and
7979 (iv) is displayed in a conspicuous manner
8080 clearly visible to the public.
8181 SECTION 3. Section 30.06, Penal Code, is amended by adding
8282 Subsection (c-1) to read as follows:
8383 (c-1) Notice provided under Subsection (c)(3)(B) or (C) may
8484 be combined in the same sign as notice provided under Section
8585 30.05(c) or Section 30.07(c)(3)(B) or (C) by including the
8686 applicable statement for each category of entry to be prohibited.
8787 If notice is given in the manner described by Subsection (c)(3)(C),
8888 and combined with notice described by Section 30.05(c)(2) or
8989 Section 30.07(c)(3)(C), it is not necessary to display more than
9090 one pictogram such as that described by Subsection (c)(3)(C)(iii)
9191 of this section. Notice provided in the manner authorized by this
9292 subsection is considered to be sufficient for purposes of
9393 prohibiting the categories of entry described by this section,
9494 Section 30.05, and Section 30.07, as applicable.
9595 SECTION 4. Section 30.07(c)(3), Penal Code, is amended to
9696 read as follows:
9797 (3) "Written communication" means:
9898 (A) a card or other document on which is written
9999 language identical to the following: "Pursuant to Section 30.07,
100100 Penal Code (trespass by license holder with an openly carried
101101 handgun), a person licensed under Subchapter H, Chapter 411,
102102 Government Code (handgun licensing law), may not enter this
103103 property with a handgun that is carried openly"; [or]
104104 (B) a sign posted on the property that:
105105 (i) includes the language described by
106106 Paragraph (A) in both English and Spanish;
107107 (ii) appears in contrasting colors with
108108 block letters at least one-half [one] inch in height; and
109109 (iii) is displayed in a conspicuous manner
110110 clearly visible to the public at each entrance to the property; or
111111 (C) a sign posted on the property that:
112112 (i) includes, in both English and Spanish,
113113 language that is identical to or substantially similar to the
114114 following: "No openly carried handguns permitted on this property";
115115 (ii) appears on a white background with
116116 black block letters at least one-half inch in height;
117117 (iii) contains a pictogram that shows, on a
118118 white background, a handgun drawn in black ink within a red circle
119119 of at least six inches in diameter and a diagonal red line across
120120 the handgun; and
121121 (iv) is displayed in a conspicuous manner
122122 clearly visible to the public.
123123 SECTION 5. Section 30.07, Penal Code, is amended by adding
124124 Subsection (c-1) to read as follows:
125125 (c-1) Notice provided under Subsection (c)(3)(B) or (C) may
126126 be combined in the same sign as notice provided under Section
127127 30.05(c) or Section 30.06(c)(3)(B) or (C) by including the
128128 applicable statement for each category of entry to be prohibited.
129129 If notice is given in the manner described by Subsection (c)(3)(C),
130130 and combined with notice described by Section 30.05(c)(2) or
131131 Section 30.06(c)(3)(C), it is not necessary to display more than
132132 one pictogram such as that described by Subsection (c)(3)(C)(iii)
133133 of this section. Notice provided in the manner authorized by this
134134 subsection is considered to be sufficient for purposes of
135135 prohibiting the categories of entry described by this section,
136136 Section 30.05, and Section 30.06, as applicable.
137137 SECTION 6. The changes in law made by this Act apply only to
138138 an offense committed on or after the effective date of this Act. An
139139 offense committed before the effective date of this Act is governed
140140 by the law in effect on the date the offense was committed, and the
141141 former law is continued in effect for that purpose.
142142 SECTION 7. This Act takes effect September 1, 2025.
