10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Chapter 562, Occupations Code, is amended by | |
12 | 12 | adding Section 562.058 to read as follows: | |
13 | 13 | 562.058 REFUSAL TO DISPENSE A PRESCRIPTION | |
14 | 14 | A pharmacist may not substitute his or her personal judgment for | |
15 | 15 | the prescribing physician's medical judgment. The fact that a | |
16 | 16 | prescription is being made for an off-label purpose is not a valid | |
17 | 17 | basis to refuse to dispense a prescription. | |
18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
22 | 22 | Act takes effect September 1, 2025. |
