 A BILL TO BE ENTITLED
 AN ACT
 relating to the practice of pharmacy and the refusal to dispense
 prescriptions.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 562, Occupations Code, is amended by
 adding Section 562.058 to read as follows:
 562.058 REFUSAL TO DISPENSE A PRESCRIPTION
 A pharmacist may not substitute his or her personal judgment for
 the prescribing physician's medical judgment. The fact that a
 prescription is being made for an off-label purpose is not a valid
 basis to refuse to dispense a prescription.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2025.
