89 relating to the establishment of the Electric Truck Advisory
910 Council.
1011 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1112 SECTION 1. Chapter 201, Transportation Code, is amended by
1213 adding Subchapter H-2 to read as follows:
1314 SUBCHAPTER H-2. ELECTRIC TRUCK ADVISORY COUNCIL
1415 Sec. 201.681. DEFINITIONS. In this subchapter:
1516 (1) "Council" means the Electric Truck Advisory
1617 Council established by this subchapter.
1718 (2) "Electric truck" includes any electric vehicle
1819 with a gross vehicle weight rating of 8,501 pounds or more.
1920 Sec. 201.682. ESTABLISHMENT; COMPOSITION. (a) The
2021 Electric Truck Advisory Council is established.
2122 (b) Subject to Subsection (c), the council is composed of:
2223 (1) at least one representative appointed by each of
2324 the following agencies and entities:
2425 (A) the governor's office;
2526 (B) the department;
2627 (C) the Public Utility Commission of Texas;
2728 (D) the Electric Reliability Council of Texas;
2829 (E) the Texas Commission on Environmental
2930 Quality;
3031 (F) the Texas Department of Licensing and
3132 Regulation; and
3233 (G) the Texas A&M Transportation Institute;
3334 (2) at least two representatives from privately owned
34- utilities providing electric service, appointed by the director;
35+ utilities providing electric service, appointed by the executive
36+ director of the Public Utility Commission of Texas;
3537 (3) at least one representative from a publicly owned
36- utility providing electric service, appointed by the director;
38+ utility providing electric service, appointed by the executive
39+ director of the Public Utility Commission of Texas;
3740 (4) at least one representative from the refueling
3841 industry with expertise in serving interstate freight
3942 transportation, appointed by the director; and
4043 (5) at least three members from the private sector,
4144 appointed by the director.
4245 (c) The director shall determine the number of
4346 representatives that each appointing authority under Subsection
4447 (b) may appoint to serve on the council.
4548 (d) A council member serves at the pleasure of the
4649 appointing authority.
4750 Sec. 201.683. TERMS; VACANCY. (a) Council members serve
4851 six-year terms.
4952 (b) A vacancy on the council shall be filled in the same
5053 manner as the original appointment. A council member appointed to
5154 fill a vacancy on the council shall serve the remainder of the
5255 unexpired term.
5356 Sec. 201.684. PRESIDING OFFICER. The representative of the
5457 department appointed under Section 201.682(b)(1) shall serve as the
5558 presiding officer.
5659 Sec. 201.685. MEETINGS. The council shall meet at least
5760 once a month or more frequently at the call of the presiding
5861 officer.
5962 Sec. 201.686. ADMINISTRATIVE ATTACHMENT; FUNDING. (a) The
6063 council is administratively attached to the department.
6164 (b) The council shall be funded using existing funds of the
6265 department.
6366 Sec. 201.687. GENERAL POWERS AND DUTIES. The council
6467 shall:
6568 (1) provide guidance on policies and incentives that
6669 encourage the adoption of electric trucks and the proliferation of
6770 required charging infrastructure;
6871 (2) provide guidance on regulatory issues specific to
6972 electric trucks to ensure that electric trucks maintain safety and
7073 performance standards;
7174 (3) serve as a forum for promoting technological
7275 advancements in battery technology, electric drivetrains,
7376 autonomous driving features, and other innovations;
7477 (4) facilitate discussions and coordination among
7578 private entities, governmental entities, and research institutions
7679 to develop and test new electric truck technologies, share best
7780 practices, and support industry-wide adoption of those
7881 technologies and practices; and
7982 (5) lead initiatives to educate stakeholders,
8083 including fleet operators, logistics companies, utilities, and
8184 policymakers, regarding electric trucks.
8285 Sec. 201.688. STATEWIDE STRATEGIC PLAN AND RELATED
8386 IMPLEMENTATION PLANS. (a) The council shall develop a strategic
8487 plan for the statewide implementation of electric truck charging
8588 infrastructure. The plan must:
8689 (1) identify strategic locations for electric truck
8790 charging infrastructure and the requirements for their development
8891 and construction, including high-capacity power sources, freight
8992 routes, and the ability to construct operation hubs;
9093 (2) specify each agency subject to the plan; and
9194 (3) make recommendations for each agency subject to
9295 the plan relating to the agency's role and responsibilities under
9396 the plan.
9497 (b) The council shall submit the strategic plan to the
9598 administrative head of each agency subject to the plan.
9699 (c) Not later than the 90th day after receiving the
97100 strategic plan, the administrative head of each agency subject to
98101 the plan shall develop and submit to the governor, the lieutenant
99102 governor, and the legislature a plan for implementing the
100103 recommendations applicable to the agency under the strategic plan.
101104 An implementation plan must include a justification for any
102105 recommendation the agency declines to implement.
103106 Sec. 201.689. APPLICATION OF SUNSET ACT. The council is
104107 subject to Chapter 325, Government Code (Texas Sunset Act). The
105108 council shall be reviewed during the period in which the department
106109 is reviewed under Section 201.204. Unless continued in existence
107110 as provided by Chapter 325, Government Code, the council is
108111 abolished and this subchapter expires on the date on which the
109112 department is subject to abolishment under that section.
110113 Sec. 201.690. APPLICATION OF OTHER LAW. Chapter 2110,
111114 Government Code, does not apply to the composition or duration of
112115 the council or to the designation of the council's presiding
113116 officer.
114117 SECTION 2. (a) Not later than January 31, 2026, the
115118 appropriate appointing authorities shall appoint the members of the
116119 Electric Truck Advisory Council as required by Section 201.682,
117120 Transportation Code, as added by this Act.
118121 (b) Not later than March 31, 2026, the Electric Truck
119122 Advisory Council established under Subchapter H-2, Transportation
120123 Code, as added by this Act, shall hold its initial meeting.
121124 (c) Not later than March 1, 2027, the Electric Truck
122125 Advisory Council shall submit the strategic plan required under
123126 Section 201.688, Transportation Code, as added by this Act.
124127 SECTION 3. This Act takes effect immediately if it receives
125128 a vote of two-thirds of all the members elected to each house, as
126129 provided by Section 39, Article III, Texas Constitution. If this
127130 Act does not receive the vote necessary for immediate effect, this
128131 Act takes effect September 1, 2025.
