A BILL TO BE ENTITLED
AN ACT
relating to the disposition of rental payments received by public
housing authorities from tenants.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 392, Local Government
Code, is amended by adding Section 392.068 to read as follows:
Sec. 392.068. DISPOSITION OF RENTAL PAYMENTS. A housing
authority shall apply a rental payment received from a tenant to any
current or delinquent rent owed by the tenant before the authority
may apply the payment to other charges, fees, or expenses owed by
the tenant, including maintenance or utility charges.
SECTION 2. This Act takes effect September 1, 2025.
