98 AN ACT
109 relating to establishing the Applied Sciences Pathway program.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Subchapter Z, Chapter 29, Education Code, is
1312 amended by adding Section 29.914 to read as follows:
1413 Sec. 29.914. APPLIED SCIENCES PATHWAY PROGRAM. (a) In this
1514 section:
1615 (1) "Certificate program" and "institution of higher
1716 education" have the meanings assigned by Section 61.003.
1817 (2) "Program" means the Applied Sciences Pathway
1918 program established under this section.
2019 (b) The commissioner shall establish and administer the
2120 Applied Sciences Pathway program to provide opportunities for
2221 students to concurrently earn high school diplomas and certificates
2322 from institutions of higher education.
2423 (c) The commissioner shall approve for participation in the
2524 program partnerships between school districts or open-enrollment
2625 charter schools and institutions of higher education to provide
2726 courses in a non-duplicative sequence of progressive achievement
2827 that lead to:
2928 (1) a high school diploma; and
3029 (2) completion of a certificate program with a
3130 successful job placement rate in high-wage, high-growth jobs in one
3231 of the following industries:
3332 (A) plumbing and pipe fitting;
3433 (B) electrical;
3534 (C) welding;
3635 (D) sheet metal;
3736 (E) carpentry;
3837 (F) masonry;
3938 (G) diesel and heavy equipment;
4039 (H) aviation maintenance;
4140 (I) heating, ventilation, and air conditioning;
4241 (J) construction management and inspection;
4342 (K) mechanical and aerospace engineering;
4443 (L) industrial maintenance and processes;
4544 (M) robotics and automation;
4645 (N) information technology and cybersecurity;
4746 (O) oil and gas exploration and production;
4847 (P) refining and chemical processes;
4948 (Q) transportation distribution and logistics;
5049 (R) manufacturing and industrial technology;
5150 (S) electronics technology; or
5251 (T) automotive technology.
5352 (c-1) Beginning with the 2027-2028 school year, the
5453 commissioner may revise the industries approved for purposes of
5554 Subsection (c)(2) once every five years to reflect current labor
5655 market trends.
5756 (d) A partnership participating in the program must:
5857 (1) enable the school district or open-enrollment
5958 charter school to provide at least one course of study described by
6059 Subsection (c) through a partnership with an institution of higher
6160 education under the program;
6261 (2) provide for a course of study described by
6362 Subsection (c) that enables a participating student in grade level
6463 11 or 12 to concurrently:
6564 (A) enroll in a certificate program described by
6665 Subsection (c)(2) at the partnering institution of higher education
6766 under which the student may receive instruction from an instructor
6867 employed by the institution and any appropriate work-based learning
6968 opportunities from the institution and earn:
7069 (i) a level one or level two certificate, as
7170 defined by the commissioner; or
7271 (ii) another certificate approved by
7372 commissioner rule; and
7473 (B) satisfy high school graduation requirements
7574 and receive a high school diploma;
7675 (3) require the partnering school district or
7776 open-enrollment charter school to permit all district or school
7877 students in grade level 11 or 12 to enroll in a course of study
7978 provided under Subdivision (2);
8079 (4) be governed by an articulation agreement between
8180 the partnering school district or open-enrollment charter school
8281 and institution of higher education; and
8382 (5) meet any other requirements established by
8483 commissioner rule.
8584 (e) The commissioner may approve the substitution of a
8685 credit in a subject area required for high school graduation under
8786 Section 28.025 with a credit in a career and technology education
8887 course provided by an institution of higher education under the
8988 program that substantially covers the essential knowledge and
9089 skills of the course for which it is substituted. This subsection
9190 may not be construed to limit the number of substituted credits a
9291 student may earn while participating in the program.
9392 (f) A career and technology education course authorized as a
9493 substitute credit under Subsection (e) may not count:
9594 (1) for more than one credit toward the student's high
9695 school graduation requirements; or
9796 (2) as a credit for more than one subject area.
9897 (g) Time that a student spends participating in the program
9998 is counted as part of the minimum number of instructional hours
10099 required for a student to be considered a full-time student in
101100 average daily attendance for purposes of Section 48.005.
102101 (h) This section may not be construed to:
103102 (1) prevent a student's participation in career and
104103 technology education or dual credit courses before the student
105104 begins participating in the program; or
106105 (2) authorize the commissioner to require approval by
107106 the commissioner for partnerships between school districts or
108107 open-enrollment charter schools and institutions of higher
109108 education for purposes other than the program, including
110109 partnerships to provide dual credit courses.
111110 (i) The commissioner shall adopt rules as necessary to
112111 administer the program.
113112 SECTION 2. This Act applies beginning with the 2025-2026
114113 school year.
115114 SECTION 3. This Act takes effect immediately if it receives
116115 a vote of two-thirds of all the members elected to each house, as
117116 provided by Section 39, Article III, Texas Constitution. If this
118117 Act does not receive the vote necessary for immediate effect, this
119118 Act takes effect September 1, 2025.
