77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the dissemination of Type 1 diabetes information by
1010 public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1313 amended by adding Section 38.0026 to read as follows:
1414 Sec. 38.0026. DISSEMINATION OF TYPE 1 DIABETES INFORMATION.
1515 (a) The Department of State Health Services shall prescribe
1616 procedures by which each school district shall provide information
1717 relating to Type 1 diabetes to district students and the parents of
1818 district students each school year. The procedures must ensure
1919 that the information is reasonably likely to come to the attention
2020 of the parents of each student. The department shall prescribe the
2121 form and content of the information. The information must cover:
2222 (1) the symptoms of the disease, how the disease may be
2323 diagnosed, and the possible consequences if left untreated;
2424 (2) a description of the risk factors and warning
2525 signs associated with the disease;
2626 (3) a description of the screening process and early
2727 detection methods for the disease and the stages of the disease; and
2828 (4) the availability and effectiveness of treatment
2929 for the disease, and a brief description of the risks and possible
3030 side effects of treatment.
3131 (b) A school district, with the written consent of the
3232 Department of State Health Services, may provide the information
3333 required by this section to district students and the parents of
3434 district students by a method different from the method prescribed
3535 by the department under Subsection (a) if the department determines
3636 that method would be effective in bringing the information to the
3737 attention of the parents of each student.
3838 SECTION 2. As soon as practicable after the effective date
3939 of this Act, the Department of State Health Services shall
4040 prescribe the procedures required by Section 38.0026, Education
4141 Code, as added by this Act.
4242 SECTION 3. This Act applies beginning with the 2025-2026
4343 school year.
4444 SECTION 4. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2025.
