9 | 9 | | relating to the dissemination of Type 1 diabetes information by |

10 | 10 | | public schools. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
---|
13 | 13 | | amended by adding Section 38.0026 to read as follows: |
---|
14 | 14 | | Sec. 38.0026. DISSEMINATION OF TYPE 1 DIABETES INFORMATION. |
---|
15 | 15 | | (a) The Department of State Health Services shall prescribe |
---|
16 | 16 | | procedures by which each school district shall provide information |
---|
17 | 17 | | relating to Type 1 diabetes to district students and the parents of |
---|
18 | 18 | | district students each school year. The procedures must ensure |
---|
19 | 19 | | that the information is reasonably likely to come to the attention |
---|
20 | 20 | | of the parents of each student. The department shall prescribe the |
---|
21 | 21 | | form and content of the information. The information must cover: |
---|
22 | 22 | | (1) the symptoms of the disease, how the disease may be |
---|
23 | 23 | | diagnosed, and the possible consequences if left untreated; |
---|
24 | 24 | | (2) a description of the risk factors and warning |
---|
25 | 25 | | signs associated with the disease; |
---|
26 | 26 | | (3) a description of the screening process and early |
---|
27 | 27 | | detection methods for the disease and the stages of the disease; and |
---|
28 | 28 | | (4) the availability and effectiveness of treatment |
---|
29 | 29 | | for the disease, and a brief description of the risks and possible |
---|
30 | 30 | | side effects of treatment. |
---|
31 | 31 | | (b) A school district, with the written consent of the |
---|
32 | 32 | | Department of State Health Services, may provide the information |
---|
33 | 33 | | required by this section to district students and the parents of |
---|
34 | 34 | | district students by a method different from the method prescribed |
---|
35 | 35 | | by the department under Subsection (a) if the department determines |
---|
36 | 36 | | that method would be effective in bringing the information to the |
---|
37 | 37 | | attention of the parents of each student. |
---|
38 | 38 | | SECTION 2. As soon as practicable after the effective date |
---|
39 | 39 | | of this Act, the Department of State Health Services shall |
---|
40 | 40 | | prescribe the procedures required by Section 38.0026, Education |
---|
41 | 41 | | Code, as added by this Act. |
---|
42 | 42 | | SECTION 3. This Act applies beginning with the 2025-2026 |
---|
43 | 43 | | school year. |
---|
44 | 44 | | SECTION 4. This Act takes effect immediately if it receives |
---|
45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
---|
46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
---|
48 | 48 | | Act takes effect September 1, 2025. |
