89R2782 MEW-F By: Lopez of Cameron H.B. No. 2049 A BILL TO BE ENTITLED AN ACT relating to the dissemination of Type 1 diabetes information by public schools. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 38, Education Code, is amended by adding Section 38.0026 to read as follows: Sec. 38.0026. DISSEMINATION OF TYPE 1 DIABETES INFORMATION. (a) The Department of State Health Services shall prescribe procedures by which each school district shall provide information relating to Type 1 diabetes to district students and the parents of district students each school year. The procedures must ensure that the information is reasonably likely to come to the attention of the parents of each student. The department shall prescribe the form and content of the information. The information must cover: (1) the symptoms of the disease, how the disease may be diagnosed, and the possible consequences if left untreated; (2) a description of the risk factors and warning signs associated with the disease; (3) a description of the screening process and early detection methods for the disease and the stages of the disease; and (4) the availability and effectiveness of treatment for the disease, and a brief description of the risks and possible side effects of treatment. (b) A school district, with the written consent of the Department of State Health Services, may provide the information required by this section to district students and the parents of district students by a method different from the method prescribed by the department under Subsection (a) if the department determines that method would be effective in bringing the information to the attention of the parents of each student. SECTION 2. As soon as practicable after the effective date of this Act, the Department of State Health Services shall prescribe the procedures required by Section 38.0026, Education Code, as added by this Act. SECTION 3. This Act applies beginning with the 2025-2026 school year. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
