88 AN ACT
99 relating to a no-evidence motion for summary judgment.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 18, Civil Practice and Remedies Code, is
1212 amended by adding Subchapter E to read as follows:
1313 SUBCHAPTER E. DISMISSAL FOR LACK OF EVIDENCE
1414 Sec. 18.121. NO-EVIDENCE MOTION FOR SUMMARY JUDGMENT. A
1515 court shall consider all evidence on the record or otherwise before
1616 the court when ruling on a no-evidence motion for summary judgment.
1717 SECTION 2. The change in law made by this Act applies to a
1818 no-evidence motion for summary judgment that is pending in a trial
1919 court on the effective date of this Act or that is filed on or after
2020 the effective date of this Act.
2121 SECTION 3. This Act takes effect September 1, 2025.
