11 | 11 | SECTION 1. Chapter 18, Civil Practice and Remedies Code, is | |
12 | 12 | amended by adding Subchapter E to read as follows: | |
13 | 13 | SUBCHAPTER E. DISMISSAL FOR LACK OF EVIDENCE | |
14 | 14 | Sec. 18.121. NO-EVIDENCE MOTION FOR SUMMARY JUDGMENT. A | |
15 | 15 | court shall consider all evidence on the record or otherwise before | |
16 | 16 | the court when ruling on a no-evidence motion for summary judgment. | |
17 | 17 | SECTION 2. The change in law made by this Act applies to a | |
18 | 18 | no-evidence motion for summary judgment that is pending in a trial | |
19 | 19 | court on the effective date of this Act or that is filed on or after | |
20 | 20 | the effective date of this Act. | |
21 | 21 | SECTION 3. This Act takes effect September 1, 2025. |
