710 AN ACT
811 relating to the composition and duties of a court security
912 committee.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Article 102.017, Code of Criminal Procedure, is
1215 amended by adding Subsection (e-1) to read as follows:
1316 (e-1) In administering or directing funds under Subsection
14- (e), a commissioners court shall consider the recommendations
17+ (e), a commissioners court shall prioritize the recommendations
1518 provided by a court security committee under Section 74.0922,
1619 Government Code.
1720 SECTION 2. Section 74.092, Government Code, is amended by
1821 amending Subsection (a) and adding Subsection (a-1) to read as
1922 follows:
2023 (a) A local administrative judge, for the courts for which
2124 the judge serves as local administrative judge, shall:
2225 (1) implement and execute the local rules of
2326 administration, including the assignment, docketing, transfer, and
2427 hearing of cases;
2528 (2) appoint any special or standing committees
2629 necessary or desirable for court management and administration;
2730 (3) promulgate local rules of administration if the
2831 other judges do not act by a majority vote;
2932 (4) recommend to the regional presiding judge any
3033 needs for assignment from outside the county to dispose of court
3134 caseloads;
3235 (5) supervise the expeditious movement of court
3336 caseloads, subject to local, regional, and state rules of
3437 administration;
3538 (6) provide the supreme court and the office of court
3639 administration requested statistical and management information;
3740 (7) set the hours and places for holding court in the
3841 county;
3942 (8) supervise the employment and performance of
4043 nonjudicial personnel;
4144 (9) supervise the budget and fiscal matters of the
4245 local courts, subject to local rules of administration;
4346 (10) coordinate and cooperate with any other local
4447 administrative judge in the district in the assignment of cases in
4548 the courts' concurrent jurisdiction for the efficient operation of
4649 the court system and the effective administration of justice;
4750 (11) if requested by the courts the judge serves,
4851 establish and maintain the lists required by Section 37.003 and
4952 ensure appointments are made from the lists in accordance with
5053 Section 37.004;
5154 (12) perform other duties as may be directed by the
5255 chief justice or a regional presiding judge; and
5356 (13) establish a court security committee to adopt
5457 security policies and procedures for all [the] courts served by the
5558 local administrative district judge that is composed of:
5659 (A) the local administrative district judge, or
5760 the judge's designee, who serves as presiding officer of the
5861 committee;
5962 (B) a representative of the sheriff's office;
6063 (C) a representative of a constable's office in
6164 the county;
6265 (D) a representative of the county commissioners
6366 court;
6467 (E) [(D)] one judge of each type of court in the
6568 county, including a justice of the peace and excluding the judge of
6669 [other than] a municipal court or a municipal court of record;
6770 (F) [(E)] a representative of any county
6871 attorney's office, district attorney's office, or criminal district
6972 attorney's office that serves in the applicable courts; and
7073 (G) [(F)] any other person the committee
7174 determines necessary to assist the committee.
7275 (a-1) Notwithstanding Section 551.001 or 552.003, a court
7376 security committee established under this section is not a
7477 governmental body for the purposes of Chapter 551 or 552.
7578 SECTION 3. Section 74.092(b), Government Code, is
7679 redesignated as Section 74.0922, Government Code, and amended to
7780 read as follows:
7881 Sec. 74.0922. DUTIES OF COURT SECURITY COMMITTEE. [(b)] A
7982 court security committee established under Section 74.092(a)(13)
8083 shall meet at least once annually and may develop and submit
8184 recommendations [recommend] to the county commissioners court on
8285 the uses of resources and expenditures of money for courthouse
8386 security, but may not direct the assignment of those resources or
8487 the expenditure of those funds.
8588 SECTION 4. This Act takes effect immediately if it receives
8689 a vote of two-thirds of all the members elected to each house, as
8790 provided by Section 39, Article III, Texas Constitution. If this
8891 Act does not receive the vote necessary for immediate effect, this
8992 Act takes effect September 1, 2025.
