7	10		AN ACT
8	11		relating to the composition and duties of a court security
9	12		committee.
10	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	14		SECTION 1. Article 102.017, Code of Criminal Procedure, is
12	15		amended by adding Subsection (e-1) to read as follows:
13	16		(e-1) In administering or directing funds under Subsection
14		-	(e), a commissioners court shall ~~consider~~ the recommendations
	17	+	(e), a commissioners court shall prioritize the recommendations
15	18		provided by a court security committee under Section 74.0922,
16	19		Government Code.
17	20		SECTION 2. Section 74.092, Government Code, is amended by
18	21		amending Subsection (a) and adding Subsection (a-1) to read as
19	22		follows:
20	23		(a) A local administrative judge, for the courts for which
21	24		the judge serves as local administrative judge, shall:
22	25		(1) implement and execute the local rules of
23	26		administration, including the assignment, docketing, transfer, and
24	27		hearing of cases;
25	28		(2) appoint any special or standing committees
26	29		necessary or desirable for court management and administration;
27	30		(3) promulgate local rules of administration if the
28	31		other judges do not act by a majority vote;
29	32		(4) recommend to the regional presiding judge any
30	33		needs for assignment from outside the county to dispose of court
31	34		caseloads;
32	35		(5) supervise the expeditious movement of court
33	36		caseloads, subject to local, regional, and state rules of
34	37		administration;
35	38		(6) provide the supreme court and the office of court
36	39		administration requested statistical and management information;
37	40		(7) set the hours and places for holding court in the
38	41		county;
39	42		(8) supervise the employment and performance of
40	43		nonjudicial personnel;
41	44		(9) supervise the budget and fiscal matters of the
42	45		local courts, subject to local rules of administration;
43	46		(10) coordinate and cooperate with any other local
44	47		administrative judge in the district in the assignment of cases in
45	48		the courts' concurrent jurisdiction for the efficient operation of
46	49		the court system and the effective administration of justice;
47	50		(11) if requested by the courts the judge serves,
48	51		establish and maintain the lists required by Section 37.003 and
49	52		ensure appointments are made from the lists in accordance with
50	53		Section 37.004;
51	54		(12) perform other duties as may be directed by the
52	55		chief justice or a regional presiding judge; and
53	56		(13) establish a court security committee to adopt
54	57		security policies and procedures for all [the] courts served by the
55	58		local administrative district judge that is composed of:
56	59		(A) the local administrative district judge, or
57	60		the judge's designee, who serves as presiding officer of the
58	61		committee;
59	62		(B) a representative of the sheriff's office;
60	63		(C) a representative of a constable's office in
61	64		the county;
62	65		(D) a representative of the county commissioners
63	66		court;
64	67		(E) [(D)] one judge of each type of court in the
65	68		county, including a justice of the peace and excluding the judge of
66	69		[other than] a municipal court or a municipal court of record;
67	70		(F) [(E)] a representative of any county
68	71		attorney's office, district attorney's office, or criminal district
69	72		attorney's office that serves in the applicable courts; and
70	73		(G) [(F)] any other person the committee
71	74		determines necessary to assist the committee.
72	75		(a-1) Notwithstanding Section 551.001 or 552.003, a court
73	76		security committee established under this section is not a
74	77		governmental body for the purposes of Chapter 551 or 552.
75	78		SECTION 3. Section 74.092(b), Government Code, is
76	79		redesignated as Section 74.0922, Government Code, and amended to
77	80		read as follows:
78	81		Sec. 74.0922. DUTIES OF COURT SECURITY COMMITTEE. [(b)] A
79	82		court security committee established under Section 74.092(a)(13)
80	83		shall meet at least once annually and may develop and submit
81	84		recommendations [recommend] to the county commissioners court on
82	85		the uses of resources and expenditures of money for courthouse
83	86		security, but may not direct the assignment of those resources or
84	87		the expenditure of those funds.
85	88		SECTION 4. This Act takes effect immediately if it receives
86	89		a vote of two-thirds of all the members elected to each house, as
87	90		provided by Section 39, Article III, Texas Constitution. If this
88	91		Act does not receive the vote necessary for immediate effect, this
89	92		Act takes effect September 1, 2025.
