108 AN ACT
119 relating to collecting and sharing capacity and enrollment
1210 information for certain day-care centers.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Subchapter C, Chapter 42, Human Resources Code,
1513 is amended by adding Section 42.0413 to read as follows:
1614 Sec. 42.0413. SUBMISSION OF CAPACITY AND ENROLLMENT DATA.
1715 (a) Each day-care center, group day-care home, and family home
1816 shall submit capacity and enrollment information to the Texas
19- Workforce Commission at least once each month and the commission
20- shall include the information on the commission's child care
21- availability portal to allow parents to locate day-care centers,
22- group day-care homes, and family homes in their geographic region
23- that have available openings.
24- (b) The information provided under this section must be
25- disaggregated by age group and include information regarding:
26- (1) the day-care center's, group day-care home's, or
27- family home's desired total capacity;
28- (2) the number of children currently enrolled in the
29- center or home; and
30- (3) the number of positions the center or home has
31- available for enrollment.
17+ Workforce Commission and the commission shall include the
18+ information on the commission's child care availability portal to
19+ allow parents to locate day-care centers, group day-care homes, and
20+ family homes in their geographic region that have available
21+ openings.
22+ (b) The information provided under this section must
23+ include:
24+ (1) information regarding the day-care center's, group
25+ day-care home's, or family home's desired total capacity; and
26+ (2) the following information disaggregated by age
27+ group:
28+ (A) the number of children currently enrolled in
29+ the center or home; and
30+ (B) the number of positions the center or home
31+ has available for enrollment.
3232 (c) Each day-care center, group day-care home, and family
33- home shall notify the Texas Workforce Commission as soon as
34- practicable after any change in the center's or home's capacity or
35- enrollment.

3637 SECTION 2. As soon as practicable after the effective date
3738 of this Act, the executive commissioner of the Health and Human
3839 Services Commission shall adopt rules necessary to implement
3940 Section 42.0413, Human Resources Code, as added by this Act.
4041 SECTION 3. This Act takes effect September 1, 2025.
