A BILL TO BE ENTITLED
AN ACT
relating to the line of succession of individuals to serve as
commander-in-chief of the state military forces.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 437.002(b), Government Code, is amended
to read as follows:
(b) If the governor is unable to perform the duties of
commander-in-chief, the successor to the governor's authority as
provided by the state constitution or other state law [adjutant
general] shall command the Texas military forces[, unless the state
constitution or other state law requires the lieutenant governor or
the president of the senate to perform the duties of governor].
SECTION 2. This Act takes effect September 1, 2025.
