| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Articles 62.102(c) and (d), Code of Criminal |
|---|
| 14 | 14 | | Procedure, are amended to read as follows: |
|---|
| 15 | 15 | | (c) If it is shown at the trial of a person for an offense or |
|---|
| 16 | 16 | | an attempt to commit an offense under this article that the person |
|---|
| 17 | 17 | | has previously been convicted of an offense or an attempt to commit |
|---|
| 18 | 18 | | an offense under this article, the [punishment for the] offense or |
|---|
| 19 | 19 | | the attempt to commit the offense is increased to the [punishment |
|---|
| 20 | 20 | | for the] next highest category of offense [degree of felony]. |
|---|
| 21 | 21 | | (d) If it is shown at the trial of a person for an offense |
|---|
| 22 | 22 | | under this article or an attempt to commit an offense under this |
|---|
| 23 | 23 | | article that the person fraudulently used identifying information |
|---|
| 24 | 24 | | in violation of Section 32.51, Penal Code, during the commission or |
|---|
| 25 | 25 | | attempted commission of the offense, the [punishment for the] |
|---|
| 26 | 26 | | offense or the attempt to commit the offense is increased to [the |
|---|
| 27 | 27 | | punishment for] the next highest category of offense [degree of |
|---|
| 28 | 28 | | felony]. |

| 29 | 29 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 30 | 30 | | to an offense committed on or after the effective date of this Act. |
|---|
| 31 | 31 | | An offense committed before the effective date of this Act is |
|---|
| 32 | 32 | | governed by the law in effect on the date the offense was committed, |
|---|
| 33 | 33 | | and the former law is continued in effect for that purpose. For |
|---|
| 34 | 34 | | purposes of this section, an offense was committed before the |
|---|
| 35 | 35 | | effective date of this Act if any element of the offense was |
|---|
| 36 | 36 | | committed before that date. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2025. |
