77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to increasing the criminal penalty for the failure of
1010 certain sex offenders to comply with sex offender registration
1111 requirements.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Articles 62.102(c) and (d), Code of Criminal
1414 Procedure, are amended to read as follows:
1515 (c) If it is shown at the trial of a person for an offense or
1616 an attempt to commit an offense under this article that the person
1717 has previously been convicted of an offense or an attempt to commit
1818 an offense under this article, the [punishment for the] offense or
1919 the attempt to commit the offense is increased to the [punishment
2020 for the] next highest category of offense [degree of felony].
2121 (d) If it is shown at the trial of a person for an offense
2222 under this article or an attempt to commit an offense under this
2323 article that the person fraudulently used identifying information
2424 in violation of Section 32.51, Penal Code, during the commission or
2525 attempted commission of the offense, the [punishment for the]
2626 offense or the attempt to commit the offense is increased to [the
2727 punishment for] the next highest category of offense [degree of
2828 felony].
2929 SECTION 2. The change in law made by this Act applies only
3030 to an offense committed on or after the effective date of this Act.
3131 An offense committed before the effective date of this Act is
3232 governed by the law in effect on the date the offense was committed,
3333 and the former law is continued in effect for that purpose. For
3434 purposes of this section, an offense was committed before the
3535 effective date of this Act if any element of the offense was
3636 committed before that date.
3737 SECTION 3. This Act takes effect September 1, 2025.
