77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a state employment preference for certain individuals
1010 who reside with veterans with a disability.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 657.002, Government Code, is amended to
1313 read as follows:
1414 Sec. 657.002. INDIVIDUALS QUALIFIED FOR MILITARY
1515 EMPLOYMENT PREFERENCE. The following individuals qualify for a
1616 military employment preference:
1717 (1) a veteran, including a veteran with a disability;
1818 (2) a veteran's surviving spouse who has not
1919 remarried;
2020 (3) an orphan of a veteran if the veteran was killed
2121 while on active duty;
2222 (4) the spouse of a member of the United States armed
2323 forces or Texas National Guard serving on active duty; [and]
2424 (5) the spouse of a veteran if the spouse is the
2525 primary source of income for the household and the veteran has a
2626 total disability rating based either on having a service-connected
2727 disability with a disability rating of at least 70 percent or on
2828 individual unemployability; and
2929 (6) an individual who resides in a household with a
3030 veteran if the individual is the primary source of income for the
3131 household and the veteran:
3232 (A) has a total disability rating based either on
3333 having a service-connected disability with a disability rating of
3434 100 percent or on individual unemployability; and
3535 (B) is receiving Supplemental Security Income
3636 (SSI) benefits under 42 U.S.C. Section 1381 et seq. or Social
3737 Security Disability Insurance (SSDI) benefits under 42 U.S.C.
3838 Section 401 et seq.
3939 SECTION 2. Section 657.003(b), Government Code, is amended
4040 to read as follows:
4141 (b) A state agency shall provide to an individual entitled
4242 to a military employment preference for employment or appointment
4343 over other applicants for the same position who do not have a
4444 greater qualification a military employment preference, in the
4545 following order of priority:
4646 (1) a veteran with a disability;
4747 (2) a veteran;
4848 (3) a spouse described by Section 657.002(4) or (5);
4949 (4) a veteran's surviving spouse who has not
5050 remarried; [and]
5151 (5) an orphan of a veteran if the veteran was killed
5252 while on active duty; and
5353 (6) an individual who resides with a veteran with a
5454 disability as described by Section 657.002(6) if the individual is
5555 the primary source of income for the veteran's household.
5656 SECTION 3. Section 657.005(b), Government Code, is amended
5757 to read as follows:
5858 (b) An applicant who is a veteran with a disability, a
5959 spouse of a veteran as described by Section 657.002(5), or an
6060 individual who resides with a veteran with a disability as
6161 described by Section 657.002(6) if the individual is the primary
6262 source of income for the veteran's household, shall furnish the
6363 official records to the individual whose duty is to fill the
6464 position.
6565 SECTION 4. The changes in law made by this Act apply only to
6666 an open position with a state agency for which the state agency
6767 begins accepting applications on or after the effective date of
6868 this Act. An open position with a state agency for which the state
6969 agency begins accepting applications before the effective date of
7070 this Act is governed by the law in effect on the date the state
7171 agency began accepting applications, and the former law is
7272 continued in effect for that purpose.
7373 SECTION 5. This Act takes effect September 1, 2025.
