7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to a state employment preference for certain individuals
10	10	who reside with veterans with a disability.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 657.002, Government Code, is amended to
13	13	read as follows:
14	14	Sec. 657.002. INDIVIDUALS QUALIFIED FOR MILITARY
15	15	EMPLOYMENT PREFERENCE. The following individuals qualify for a
16	16	military employment preference:
17	17	(1) a veteran, including a veteran with a disability;
18	18	(2) a veteran's surviving spouse who has not
19	19	remarried;
20	20	(3) an orphan of a veteran if the veteran was killed
21	21	while on active duty;
22	22	(4) the spouse of a member of the United States armed
23	23	forces or Texas National Guard serving on active duty; [and]
24	24	(5) the spouse of a veteran if the spouse is the
25	25	primary source of income for the household and the veteran has a
26	26	total disability rating based either on having a service-connected
27	27	disability with a disability rating of at least 70 percent or on
28	28	individual unemployability; and
29	29	(6) an individual who resides in a household with a
30	30	veteran if the individual is the primary source of income for the
31	31	household and the veteran:
32	32	(A) has a total disability rating based either on
33	33	having a service-connected disability with a disability rating of
34	34	100 percent or on individual unemployability; and
35	35	(B) is receiving Supplemental Security Income
36	36	(SSI) benefits under 42 U.S.C. Section 1381 et seq. or Social
37	37	Security Disability Insurance (SSDI) benefits under 42 U.S.C.
38	38	Section 401 et seq.
39	39	SECTION 2. Section 657.003(b), Government Code, is amended
40	40	to read as follows:
41	41	(b) A state agency shall provide to an individual entitled
42	42	to a military employment preference for employment or appointment
43	43	over other applicants for the same position who do not have a
44	44	greater qualification a military employment preference, in the
45	45	following order of priority:
46	46	(1) a veteran with a disability;
47	47	(2) a veteran;
48	48	(3) a spouse described by Section 657.002(4) or (5);
49	49	(4) a veteran's surviving spouse who has not
50	50	remarried; [and]
51	51	(5) an orphan of a veteran if the veteran was killed
52	52	while on active duty; and
53	53	(6) an individual who resides with a veteran with a
54	54	disability as described by Section 657.002(6) if the individual is
55	55	the primary source of income for the veteran's household.
56	56	SECTION 3. Section 657.005(b), Government Code, is amended
57	57	to read as follows:
58	58	(b) An applicant who is a veteran with a disability, a
59	59	spouse of a veteran as described by Section 657.002(5), or an
60	60	individual who resides with a veteran with a disability as
61	61	described by Section 657.002(6) if the individual is the primary
62	62	source of income for the veteran's household, shall furnish the
63	63	official records to the individual whose duty is to fill the
64	64	position.
65	65	SECTION 4. The changes in law made by this Act apply only to
66	66	an open position with a state agency for which the state agency
67	67	begins accepting applications on or after the effective date of
68	68	this Act. An open position with a state agency for which the state
69	69	agency begins accepting applications before the effective date of
70	70	this Act is governed by the law in effect on the date the state
71	71	agency began accepting applications, and the former law is
72	72	continued in effect for that purpose.
73	73	SECTION 5. This Act takes effect September 1, 2025.
