99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the prosecution of the offense of deadly conduct.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 22.05, Penal Code, is amended by
1414 amending Subsection (c) and adding Subsection (f) to read as
1515 follows:
1616 (c) Except as otherwise provided by this subsection,
1717 recklessness [Recklessness] and danger are presumed if the actor
1818 knowingly pointed a firearm at or in the direction of another
1919 whether or not the actor believed the firearm to be loaded. The
2020 presumption under this subsection does not apply to a peace officer
2121 engaged in the actual discharge of the officer's official duties.
2222 (f) Subsection (b)(1) does not apply to a peace officer
2323 engaged in the actual discharge of the officer's official duties.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an offense committed on or after the effective date of this Act.
2626 An offense committed before the effective date of this Act is
2727 governed by the law in effect on the date the offense was committed,
2828 and the former law is continued in effect for that purpose. For
2929 purposes of this section, an offense was committed before the
3030 effective date of this Act if any element of the offense occurred
3131 before that date.
3232 SECTION 3. This Act takes effect September 1, 2025.
