10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Article 26.011, Code of Criminal Procedure, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | Art. 26.011. WAIVER OF ARRAIGNMENT. (a) An attorney | |
14 | 14 | representing a defendant may present a waiver of arraignment, and | |
15 | 15 | the clerk of the court may not require the presence of the defendant | |
16 | 16 | as a condition of accepting the waiver. | |
17 | 17 | (b) An attorney representing a defendant may sign a waiver | |
18 | 18 | of arraignment on the defendant's behalf. | |
19 | 19 | SECTION 2. This Act takes effect September 1, 2025. |
