88 AN ACT
99 relating to medical education coursework in cultural competence and
1010 implicit bias.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 51, Education Code, is
1313 amended by adding Section 51.310 to read as follows:
1414 Sec. 51.310. CULTURAL COMPETENCE AND IMPLICIT BIAS MEDICAL
1515 EDUCATION COURSEWORK. (a) In this section:
1616 (1) "Coordinating board" means the Texas Higher
1717 Education Coordinating Board.
1818 (2) "Cultural competence" and "implicit bias" have the
1919 meanings assigned by Section 153.017, Occupations Code.
2020 (3) "Medical school" has the meaning assigned by
2121 Section 61.501.
2222 (b) The coordinating board by rule shall require a medical
2323 school to offer coursework in cultural competence and implicit bias
2424 approved by the Texas Medical Board under Section 153.017(b),
2525 Occupations Code.
2626 (c) A medical school may not award a student a doctor of
2727 medicine (M.D.) or doctor of osteopathic medicine (D.O.) degree
2828 unless the student has successfully completed the number of hours
2929 of coursework in cultural competence and implicit bias required by
3030 coordinating board rule.
3131 SECTION 2. Subchapter A, Chapter 153, Occupations Code, is
3232 amended by adding Section 153.017 to read as follows:
3333 Sec. 153.017. COURSEWORK IN CULTURAL COMPETENCE AND
3434 IMPLICIT BIAS. (a) In this section:
3535 (1) "Cultural competence" means, with respect to
3636 health care, the ability to effectively address the health issues
3737 of individuals from diverse backgrounds by applying knowledge,
3838 empathy, and insight into the views on health that those
3939 backgrounds present.
4040 (2) "Implicit bias" means:
4141 (A) bias in judgment or behavior that results
4242 from subtle cognitive processes, including implicit attitudes and
4343 stereotypes, that often operate at a level below conscious
4444 awareness and without intentional control; or
4545 (B) implicit attitudes and stereotypes that
4646 result in beliefs or simple associations that a person makes
4747 between an object and its evaluation that are automatically
4848 activated by the mere presence, actual or symbolic, of the attitude
4949 object.
5050 (b) The board by rule shall approve coursework in cultural
5151 competence and implicit bias for purposes of Section 51.310,
5252 Education Code.
5353 (c) Coursework approved under Subsection (b) must be:
5454 (1) designed to address medical decisions and
5555 treatment relating to a person's race, ethnicity, nationality,
5656 language, sex, gender, physical and mental ability, and
5757 socioeconomic status; and
5858 (2) developed in consultation with:
5959 (A) the Texas Higher Education Coordinating
6060 Board; and
6161 (B) the Association of American Medical Colleges
6262 or another nationally recognized organization that reviews medical
6363 school curricula.
6464 SECTION 3. Not later than December 1, 2025, the Texas Higher
6565 Education Coordinating Board and the Texas Medical Board shall
6666 adopt the rules necessary to implement this Act.
6767 SECTION 4. Section 51.310(c), Education Code, as added by
6868 this Act, applies only to a student who enrolls in a doctor of
6969 medicine (M.D.) or doctor of osteopathic medicine (D.O.) degree
7070 program on or after January 1, 2026.
7171 SECTION 5. This Act takes effect September 1, 2025.
