87 A BILL TO BE ENTITLED
98 AN ACT
109 relating to the open meetings law.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Section 551.001(3), Government Code, is amended
1312 to read as follows:
1413 (3) "Governmental body" means:
1514 (A) a board, commission, department, committee,
1615 or agency within the executive or legislative branch of state
1716 government that is directed by one or more elected or appointed
1817 members;
1918 (B) a county commissioners court in the state;
2019 (C) a municipal governing body in the state;
2120 (D) a deliberative body that has rulemaking or
2221 quasi-judicial power and that is classified as a department,
2322 agency, or political subdivision of a county or municipality;
2423 (E) a school district board of trustees;
2524 (F) a county board of school trustees;
2625 (G) a county board of education;
2726 (H) the governing board of a special district
2827 created by law;
2928 (I) a local workforce development board created
3029 under Section 2308.253;
3130 (J) a nonprofit corporation that is eligible to
3231 receive funds under the federal community services block grant
3332 program and that is authorized by this state to serve a geographic
3433 area of the state;
3534 (K) a nonprofit corporation organized under
3635 Chapter 67, Water Code, that provides a water supply or wastewater
3736 service, or both, and is exempt from ad valorem taxation under
3837 Section 11.30, Tax Code;
3938 (L) a joint board created under Section 22.074,
4039 Transportation Code; [and]
4140 (M) a board of directors of a reinvestment zone
4241 created under Chapter 311, Tax Code; and
4342 (N) a board of managers appointed under Chapter
4443 39A, Education Code.
4544 SECTION 2. Section 551.041, Government Code, is amended to
4645 read as follows:
4746 Sec. 551.041. NOTICE OF MEETING REQUIRED. (a) A
4847 governmental body shall give written notice of the date, hour,
4948 place, and subject of each meeting held by the governmental body.
5049 (b) The notice must include an agenda for the meeting that
5150 is the subject of the notice that:
5251 (1) is sufficiently specific to inform the public of
5352 each subject to be considered in the open portion of the meeting,
5453 including any matter:
5554 (A) that is special or unusual; or
5655 (B) in which the public may have a particular
5756 interest; and
5857 (2) describes any subject to be considered in the
5958 closed portion of the meeting, if applicable.
6059 SECTION 3. Section 551.074, Government Code, is amended to
6160 read as follows:
6261 Sec. 551.074. PERSONNEL MATTERS; CLOSED MEETING. (a) This
6362 chapter does not require a governmental body to conduct an open
6463 meeting:
6564 (1) to deliberate the appointment, employment,
6665 evaluation, reassignment, duties, discipline, or dismissal of a
6766 specific public officer or employee; or
6867 (2) to hear a complaint or charge against an officer or
6968 employee.
7069 (b) Subsection (a) does not apply if:
7170 (1) the officer or employee who is the subject of the
7271 deliberation or hearing requests a public hearing; or
7372 (2) the governmental body's deliberations under
7473 Subsection (a)(1) concern operational issues that generally impact
7574 a class or group of employees, including changes in the duties or
7675 compensation of a class or group of employees.
7776 SECTION 4. Section 551.083, Government Code, is repealed.
7877 SECTION 5. The changes in law made by this Act apply only to
7978 a meeting of a governmental body held on or after the effective date
8079 of this Act.
8180 SECTION 6. This Act takes effect September 1, 2025.
