| 11 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 11 | | SECTION 1. Section 551.001(3), Government Code, is amended |
|---|
| 13 | 12 | | to read as follows: |
|---|
| 14 | 13 | | (3) "Governmental body" means: |
|---|
| 15 | 14 | | (A) a board, commission, department, committee, |
|---|
| 16 | 15 | | or agency within the executive or legislative branch of state |
|---|
| 17 | 16 | | government that is directed by one or more elected or appointed |
|---|
| 18 | 17 | | members; |
|---|
| 19 | 18 | | (B) a county commissioners court in the state; |
|---|
| 20 | 19 | | (C) a municipal governing body in the state; |
|---|
| 21 | 20 | | (D) a deliberative body that has rulemaking or |
|---|
| 22 | 21 | | quasi-judicial power and that is classified as a department, |
|---|
| 23 | 22 | | agency, or political subdivision of a county or municipality; |
|---|
| 24 | 23 | | (E) a school district board of trustees; |
|---|
| 25 | 24 | | (F) a county board of school trustees; |
|---|
| 26 | 25 | | (G) a county board of education; |
|---|
| 27 | 26 | | (H) the governing board of a special district |
|---|
| 28 | 27 | | created by law; |
|---|
| 29 | 28 | | (I) a local workforce development board created |
|---|
| 30 | 29 | | under Section 2308.253; |
|---|
| 31 | 30 | | (J) a nonprofit corporation that is eligible to |
|---|
| 32 | 31 | | receive funds under the federal community services block grant |
|---|
| 33 | 32 | | program and that is authorized by this state to serve a geographic |
|---|
| 34 | 33 | | area of the state; |
|---|
| 35 | 34 | | (K) a nonprofit corporation organized under |
|---|
| 36 | 35 | | Chapter 67, Water Code, that provides a water supply or wastewater |
|---|
| 37 | 36 | | service, or both, and is exempt from ad valorem taxation under |
|---|
| 38 | 37 | | Section 11.30, Tax Code; |
|---|
| 39 | 38 | | (L) a joint board created under Section 22.074, |
|---|
| 40 | 39 | | Transportation Code; [and] |
|---|
| 41 | 40 | | (M) a board of directors of a reinvestment zone |
|---|
| 42 | 41 | | created under Chapter 311, Tax Code; and |
|---|
| 43 | 42 | | (N) a board of managers appointed under Chapter |
|---|
| 44 | 43 | | 39A, Education Code. |
|---|
| 45 | 44 | | SECTION 2. Section 551.041, Government Code, is amended to |
|---|
| 46 | 45 | | read as follows: |
|---|
| 47 | 46 | | Sec. 551.041. NOTICE OF MEETING REQUIRED. (a) A |
|---|
| 48 | 47 | | governmental body shall give written notice of the date, hour, |
|---|
| 49 | 48 | | place, and subject of each meeting held by the governmental body. |
|---|
| 50 | 49 | | (b) The notice must include an agenda for the meeting that |
|---|
| 51 | 50 | | is the subject of the notice that: |
|---|
| 52 | 51 | | (1) is sufficiently specific to inform the public of |
|---|
| 53 | 52 | | each subject to be considered in the open portion of the meeting, |
|---|
| 54 | 53 | | including any matter: |
|---|
| 55 | 54 | | (A) that is special or unusual; or |
|---|
| 56 | 55 | | (B) in which the public may have a particular |
|---|
| 57 | 56 | | interest; and |
|---|
| 58 | 57 | | (2) describes any subject to be considered in the |
|---|
| 59 | 58 | | closed portion of the meeting, if applicable. |
|---|
| 60 | 59 | | SECTION 3. Section 551.074, Government Code, is amended to |
|---|
| 61 | 60 | | read as follows: |
|---|
| 62 | 61 | | Sec. 551.074. PERSONNEL MATTERS; CLOSED MEETING. (a) This |
|---|
| 63 | 62 | | chapter does not require a governmental body to conduct an open |
|---|
| 64 | 63 | | meeting: |
|---|
| 65 | 64 | | (1) to deliberate the appointment, employment, |
|---|
| 66 | 65 | | evaluation, reassignment, duties, discipline, or dismissal of a |
|---|
| 67 | 66 | | specific public officer or employee; or |
|---|
| 68 | 67 | | (2) to hear a complaint or charge against an officer or |
|---|
| 69 | 68 | | employee. |
|---|
| 70 | 69 | | (b) Subsection (a) does not apply if: |
|---|
| 71 | 70 | | (1) the officer or employee who is the subject of the |
|---|
| 72 | 71 | | deliberation or hearing requests a public hearing; or |
|---|
| 73 | 72 | | (2) the governmental body's deliberations under |
|---|
| 74 | 73 | | Subsection (a)(1) concern operational issues that generally impact |
|---|
| 75 | 74 | | a class or group of employees, including changes in the duties or |
|---|
| 76 | 75 | | compensation of a class or group of employees. |
|---|
| 77 | 76 | | SECTION 4. Section 551.083, Government Code, is repealed. |
|---|
| 78 | 77 | | SECTION 5. The changes in law made by this Act apply only to |
|---|
| 79 | 78 | | a meeting of a governmental body held on or after the effective date |
|---|
| 80 | 79 | | of this Act. |
|---|
| 81 | 80 | | SECTION 6. This Act takes effect September 1, 2025. |
