77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to vehicles eligible for replacement under the clean
1010 school bus program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 390.002(b), Health and Safety Code, is
1313 amended to read as follows:
1414 (b) Projects that may be considered for a grant under the
1515 program include:
1616 (1) diesel oxidation catalysts for school buses built
1717 before 1994;
1818 (2) diesel particulate filters for school buses built
1919 from 1994 to 1998;
2020 (3) the purchase and use of emission-reducing add-on
2121 equipment for school buses, including devices that reduce crankcase
2222 emissions;
2323 (4) the use of qualifying fuel;
2424 (5) other technologies that the commission finds will
2525 bring about significant emissions reductions; and
2626 (6) replacement of a pre-2011 [pre-2007] model year
2727 school bus.
2828 SECTION 2. Sections 390.004(c) and (d), Health and Safety
2929 Code, are amended to read as follows:
3030 (c) A school bus proposed for replacement must:
3131 (1) be of model year 2010 [2006] or earlier;
3232 (2) have been owned and operated by the applicant for
3333 at least the two years before submission of the grant application;
3434 (3) be in good operational condition; and
3535 (4) be currently used on a regular, daily route to and
3636 from a school.
3737 (d) A school bus proposed for purchase to replace a pre-2011
3838 [pre-2007] model year school bus must be of the current model year
3939 or the year before the current model year at the time of submission
4040 of the grant application.
4141 SECTION 3. This Act takes effect September 1, 2025.
