| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 390.002(b), Health and Safety Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (b) Projects that may be considered for a grant under the |
|---|
| 15 | 15 | | program include: |
|---|
| 16 | 16 | | (1) diesel oxidation catalysts for school buses built |
|---|
| 17 | 17 | | before 1994; |
|---|
| 18 | 18 | | (2) diesel particulate filters for school buses built |
|---|
| 19 | 19 | | from 1994 to 1998; |
|---|
| 20 | 20 | | (3) the purchase and use of emission-reducing add-on |
|---|
| 21 | 21 | | equipment for school buses, including devices that reduce crankcase |
|---|
| 22 | 22 | | emissions; |
|---|
| 23 | 23 | | (4) the use of qualifying fuel; |
|---|
| 24 | 24 | | (5) other technologies that the commission finds will |
|---|
| 25 | 25 | | bring about significant emissions reductions; and |
|---|
| 26 | 26 | | (6) replacement of a pre-2011 [pre-2007] model year |
|---|
| 27 | 27 | | school bus. |

| 28 | 28 | | SECTION 2. Sections 390.004(c) and (d), Health and Safety |
|---|
| 29 | 29 | | Code, are amended to read as follows: |
|---|
| 30 | 30 | | (c) A school bus proposed for replacement must: |
|---|
| 31 | 31 | | (1) be of model year 2010 [2006] or earlier; |
|---|
| 32 | 32 | | (2) have been owned and operated by the applicant for |
|---|
| 33 | 33 | | at least the two years before submission of the grant application; |
|---|
| 34 | 34 | | (3) be in good operational condition; and |
|---|
| 35 | 35 | | (4) be currently used on a regular, daily route to and |
|---|
| 36 | 36 | | from a school. |
|---|
| 37 | 37 | | (d) A school bus proposed for purchase to replace a pre-2011 |
|---|
| 38 | 38 | | [pre-2007] model year school bus must be of the current model year |
|---|
| 39 | 39 | | or the year before the current model year at the time of submission |
|---|
| 40 | 40 | | of the grant application. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2025. |
