77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to increasing the criminal penalty for the offense of
1010 indecent assault against a disabled or elderly individual.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 22.012(b) and (d), Penal Code, are
1313 amended to read as follows:
1414 (b) An offense under this section is a Class A misdemeanor,
1515 except that the offense is:
1616 (1) a state jail felony if it is shown on the trial of
1717 the offense that:
1818 (A) the defendant has been previously convicted
1919 of an offense under this section, other than an offense punishable
2020 under Paragraph (B); or
2121 (B) the defendant is a health care services
2222 provider or a mental health services provider and the act is:
2323 (i) committed during the course of
2424 providing a treatment or service to the victim; and
2525 (ii) beyond the scope of generally accepted
2626 practices for the treatment or service; [or]
2727 (2) a felony of the third degree if it is shown on the
2828 trial of the offense that the defendant has been previously
2929 convicted of an offense under this section that is punishable under
3030 Subdivision (1)(B); or
3131 (3) a felony of the second degree if the victim is a
3232 disabled individual or an elderly individual.
3333 (d) In this section: [,]
3434 (1) "Disabled individual" and "elderly individual"
3535 have the meanings assigned by Section 22.04.
3636 (2) "Health ["health] care services provider" and
3737 "mental health services provider" have the meanings assigned by
3838 Section 22.011.
3939 SECTION 2. The change in law made by this Act applies only
4040 to an offense committed on or after the effective date of this Act.
4141 An offense committed before the effective date of this Act is
4242 governed by the law in effect on the date the offense was committed,
4343 and the former law is continued in effect for that purpose. For
4444 purposes of this section, an offense was committed before the
4545 effective date of this Act if any element of the offense occurred
4646 before that date.
4747 SECTION 3. This Act takes effect September 1, 2025.
