| 9 | 9 | | relating to increasing the criminal penalty for the offense of |
|---|
| 10 | 10 | | indecent assault against a disabled or elderly individual. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 22.012(b) and (d), Penal Code, are |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (b) An offense under this section is a Class A misdemeanor, |
|---|
| 15 | 15 | | except that the offense is: |
|---|
| 16 | 16 | | (1) a state jail felony if it is shown on the trial of |
|---|
| 17 | 17 | | the offense that: |
|---|
| 18 | 18 | | (A) the defendant has been previously convicted |
|---|
| 19 | 19 | | of an offense under this section, other than an offense punishable |
|---|
| 20 | 20 | | under Paragraph (B); or |
|---|
| 21 | 21 | | (B) the defendant is a health care services |
|---|
| 22 | 22 | | provider or a mental health services provider and the act is: |
|---|
| 23 | 23 | | (i) committed during the course of |
|---|
| 24 | 24 | | providing a treatment or service to the victim; and |
|---|
| 25 | 25 | | (ii) beyond the scope of generally accepted |
|---|
| 26 | 26 | | practices for the treatment or service; [or] |
|---|
| 27 | 27 | | (2) a felony of the third degree if it is shown on the |
|---|
| 28 | 28 | | trial of the offense that the defendant has been previously |
|---|
| 29 | 29 | | convicted of an offense under this section that is punishable under |
|---|
| 30 | 30 | | Subdivision (1)(B); or |
|---|
| 31 | 31 | | (3) a felony of the second degree if the victim is a |
|---|
| 32 | 32 | | disabled individual or an elderly individual. |
|---|
| 33 | 33 | | (d) In this section: [,] |
|---|
| 34 | 34 | | (1) "Disabled individual" and "elderly individual" |
|---|
| 35 | 35 | | have the meanings assigned by Section 22.04. |
|---|
| 36 | 36 | | (2) "Health ["health] care services provider" and |
|---|
| 37 | 37 | | "mental health services provider" have the meanings assigned by |
|---|
| 38 | 38 | | Section 22.011. |
|---|
| 39 | 39 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 40 | 40 | | to an offense committed on or after the effective date of this Act. |
|---|
| 41 | 41 | | An offense committed before the effective date of this Act is |
|---|
| 42 | 42 | | governed by the law in effect on the date the offense was committed, |
|---|
| 43 | 43 | | and the former law is continued in effect for that purpose. For |
|---|
| 44 | 44 | | purposes of this section, an offense was committed before the |
|---|
| 45 | 45 | | effective date of this Act if any element of the offense occurred |
|---|
| 46 | 46 | | before that date. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2025. |
