10 | 10 | | facility or residential care facility. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 1(c), Article 46.04, Code of Criminal |
---|
13 | 13 | | Procedure, is amended to read as follows: |
---|
14 | 14 | | (c) A female patient must be accompanied by a female |
---|
15 | 15 | | attendant unless: |
---|
16 | 16 | | (1) the patient is transported by a male attendant who |
---|
17 | 17 | | is wearing a body worn camera, as defined by Article 2B.0101, that |
---|
18 | 18 | | is activated for the duration of the patient's transport; or |
---|
19 | 19 | | (2) the vehicle in which the patient is transported is |
---|
20 | 20 | | equipped with audio or video recording devices that actively record |
---|
21 | 21 | | for the duration of the patient's transport. |
---|
22 | 22 | | SECTION 2. Section 574.045(d), Health and Safety Code, is |
---|
23 | 23 | | amended to read as follows: |
---|
24 | 24 | | (d) A female patient must be accompanied by a female |
---|
25 | 25 | | attendant unless: |
---|
26 | 26 | | (1) the patient is accompanied by her father, husband, |
---|
27 | 27 | | or adult brother or son; |
---|
28 | 28 | | (2) the patient is transported by a male attendant who |
---|
29 | 29 | | is wearing a body worn camera, as defined by Article 2B.0101, Code |
---|
30 | 30 | | of Criminal Procedure, that is activated for the duration of the |
---|
31 | 31 | | patient's transport; or |
---|
32 | 32 | | (3) the vehicle in which the patient is transported is |
---|
33 | 33 | | equipped with audio or video recording devices that actively record |
---|
34 | 34 | | for the duration of the patient's transport. |
---|
35 | 35 | | SECTION 3. This Act takes effect September 1, 2025. |
