77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the transport of female patients to a mental health
1010 facility or residential care facility.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1(c), Article 46.04, Code of Criminal
1313 Procedure, is amended to read as follows:
1414 (c) A female patient must be accompanied by a female
1515 attendant unless:
1616 (1) the patient is transported by a male attendant who
1717 is wearing a body worn camera, as defined by Article 2B.0101, that
1818 is activated for the duration of the patient's transport; or
1919 (2) the vehicle in which the patient is transported is
2020 equipped with audio or video recording devices that actively record
2121 for the duration of the patient's transport.
2222 SECTION 2. Section 574.045(d), Health and Safety Code, is
2323 amended to read as follows:
2424 (d) A female patient must be accompanied by a female
2525 attendant unless:
2626 (1) the patient is accompanied by her father, husband,
2727 or adult brother or son;
2828 (2) the patient is transported by a male attendant who
2929 is wearing a body worn camera, as defined by Article 2B.0101, Code
3030 of Criminal Procedure, that is activated for the duration of the
3131 patient's transport; or
3232 (3) the vehicle in which the patient is transported is
3333 equipped with audio or video recording devices that actively record
3434 for the duration of the patient's transport.
3535 SECTION 3. This Act takes effect September 1, 2025.
