 A BILL TO BE ENTITLED
 AN ACT
 relating to the transport of female patients to a mental health
 facility or residential care facility.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 1(c), Article 46.04, Code of Criminal
 Procedure, is amended to read as follows:
 (c)  A female patient must be accompanied by a female
 attendant unless:
 (1)  the patient is transported by a male attendant who
 is wearing a body worn camera, as defined by Article 2B.0101, that
 is activated for the duration of the patient's transport; or
 (2)  the vehicle in which the patient is transported is
 equipped with audio or video recording devices that actively record
 for the duration of the patient's transport.
 SECTION 2.  Section 574.045(d), Health and Safety Code, is
 amended to read as follows:
 (d)  A female patient must be accompanied by a female
 attendant unless:
 (1)  the patient is accompanied by her father, husband,
 or adult brother or son;
 (2)  the patient is transported by a male attendant who
 is wearing a body worn camera, as defined by Article 2B.0101, Code
 of Criminal Procedure, that is activated for the duration of the
 patient's transport; or
 (3)  the vehicle in which the patient is transported is
 equipped with audio or video recording devices that actively record
 for the duration of the patient's transport.
 SECTION 3.  This Act takes effect September 1, 2025.
