88 AN ACT
99 relating to the liability of a pilot performing pilot services on
1010 Matagorda and Lavaca Bays.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 65, Transportation Code, is amended by
1313 designating Sections 65.001 through 65.003 as Subchapter A and
1414 adding a subchapter heading to read as follows:
1515 SUBCHAPTER A. GENERAL PROVISIONS
1616 SECTION 2. Chapter 65, Transportation Code, is amended by
1717 adding Subchapter B to read as follows:
1818 SUBCHAPTER B. PILOT LIABILITY
1919 Sec. 65.051. DEFINITIONS. In this subchapter:
2020 (1) "Pilot" means a person who is appointed as a pilot
2121 under this chapter.
2222 (2) "Pilot services" means acts of a pilot in
2323 conducting a vessel through the navigable water in this state and
2424 the ports in which the pilot is appointed as a pilot.
2525 Sec. 65.052. PURPOSE. The purpose of this subchapter is to:
2626 (1) in the public interest, stimulate and preserve
2727 maritime commerce on the pilotage grounds of this state by limiting
2828 and regulating the liability of pilots; and
2929 (2) maintain pilotage fees at reasonable amounts.
3030 Sec. 65.053. PILOT LIABILITY. A pilot is not liable
3131 directly or as a member of an organization of pilots for any claim
3232 that:
3333 (1) arises from an act or omission of another pilot or
3434 organization of pilots; and
3535 (2) relates directly or indirectly to pilot services.
3636 Sec. 65.054. PILOT LIABILITY LIMITED. (a) A pilot
3737 providing pilot services is not liable for more than $1,000 for
3838 damage or loss caused by the pilot's error, omission, fault, or
3939 neglect in the performance of the pilot services, except as
4040 provided by Subsection (b).
4141 (b) Subsection (a) does not apply to:
4242 (1) damage or loss that arises because of wilful
4343 misconduct or gross negligence of the pilot;
4444 (2) liability for exemplary damages for gross
4545 negligence of the pilot and for which no other person is jointly or
4646 severally liable; or
4747 (3) an act or omission relating to the ownership and
4848 operation of a pilot boat unless the pilot boat is directly involved
4949 in pilot services other than the transportation of pilots.
5050 (c) This section does not exempt a vessel or its owner or
5151 operator from liability for damage or loss caused by the vessel to a
5252 person or property on the grounds that:
5353 (1) the vessel was piloted by a pilot; or
5454 (2) the damage or loss was caused by the error,
5555 omission, fault, or neglect of a pilot.
5656 (d) In an action brought against a pilot for an act or
5757 omission for which liability is limited as provided by this section
5858 and in which other claims are made or anticipated with respect to
5959 the same act or omission, the court shall dismiss the proceedings as
6060 to the pilot to the extent the pleadings allege pilot liability that
6161 exceeds $1,000.
6262 SECTION 3. (a) Section 65.053, Transportation Code, as
6363 added by this Act, applies only to an act or omission that occurs on
6464 or after the effective date of this Act. An act or omission that
6565 occurs before the effective date of this Act is governed by the law
6666 in effect on the date the act or omission occurred, and the former
6767 law is continued in effect for that purpose.
6868 (b) Section 65.054, Transportation Code, as added by this
6969 Act, applies only to an action commenced on or after the effective
7070 date of this Act. An action commenced before the effective date of
7171 this Act is governed by the law applicable to the action immediately
7272 before the effective date of this Act, and that law is continued in
7373 effect for that purpose.
7474 SECTION 4. This Act takes effect September 1, 2025.
