89 relating to construction standards for certain recreational
910 vehicle parks and campgrounds.
1011 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1112 SECTION 1. Subtitle A, Title 9, Health and Safety Code, is
1213 amended by adding Chapter 764 to read as follows:
1314 CHAPTER 764. RECREATIONAL VEHICLE PARK AND CAMPGROUND CONSTRUCTION
1415 STANDARDS
1516 Sec. 764.001. DEFINITION. In this chapter, "governmental
1617 entity" means this state or a state agency or political subdivision
1718 of this state.
1819 Sec. 764.002. APPLICABILITY. This chapter applies only to
1920 a recreational vehicle park or campground consisting of a privately
2021 owned parcel or tract of land under the control of a person or
2122 entity, other than a governmental entity, on which sites for
2223 recreational vehicles, recreational park trailers, or other
2324 camping units are offered primarily for transient guest use by
2425 members of the public or an organization for overnight stays.
2526 Sec. 764.003. MINIMUM STANDARDS. A recreational vehicle
2627 park or campground to which this chapter applies must comply with
2728 the National Fire Protection Association 1194, Standard for
2829 Recreational Vehicle Parks and Campgrounds, 2021 Edition, other
29- than Sections 1.1.1 and 5.1.1.1.

3031 Sec. 764.004. EFFECT OF OTHER LAW. A governmental entity
3132 may adopt a policy, rule, ordinance, or order to regulate
3233 environmental health and sanitation, electrical distribution
3334 system safety, liquefied petroleum gas storage and dispensing
3435 safety, or fire protection only if the policy, rule, ordinance, or
3536 order does not impose standards more stringent than the standards
3637 imposed under Section 764.003.
3738 SECTION 2. Notwithstanding Chapter 764, Health and Safety
3839 Code, as added by this Act, a recreational vehicle park or
3940 campground to which that chapter applies operating on the effective
4041 date of this Act is not required to comply with that chapter before
4142 September 1, 2026.
4243 SECTION 3. This Act takes effect September 1, 2025.
