| 10 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 12 | | SECTION 1. Subtitle A, Title 9, Health and Safety Code, is |
|---|
| 12 | 13 | | amended by adding Chapter 764 to read as follows: |
|---|
| 13 | 14 | | CHAPTER 764. RECREATIONAL VEHICLE PARK AND CAMPGROUND CONSTRUCTION |

| 14 | 15 | | STANDARDS |
|---|
| 15 | 16 | | Sec. 764.001. DEFINITION. In this chapter, "governmental |
|---|
| 16 | 17 | | entity" means this state or a state agency or political subdivision |
|---|
| 17 | 18 | | of this state. |
|---|
| 18 | 19 | | Sec. 764.002. APPLICABILITY. This chapter applies only to |
|---|
| 19 | 20 | | a recreational vehicle park or campground consisting of a privately |
|---|
| 20 | 21 | | owned parcel or tract of land under the control of a person or |
|---|
| 21 | 22 | | entity, other than a governmental entity, on which sites for |
|---|
| 22 | 23 | | recreational vehicles, recreational park trailers, or other |
|---|
| 23 | 24 | | camping units are offered primarily for transient guest use by |
|---|
| 24 | 25 | | members of the public or an organization for overnight stays. |
|---|
| 25 | 26 | | Sec. 764.003. MINIMUM STANDARDS. A recreational vehicle |
|---|
| 26 | 27 | | park or campground to which this chapter applies must comply with |
|---|
| 27 | 28 | | the National Fire Protection Association 1194, Standard for |
|---|
| 28 | 29 | | Recreational Vehicle Parks and Campgrounds, 2021 Edition, other |
|---|
| 30 | 31 | | Sec. 764.004. EFFECT OF OTHER LAW. A governmental entity |
|---|
| 31 | 32 | | may adopt a policy, rule, ordinance, or order to regulate |
|---|
| 32 | 33 | | environmental health and sanitation, electrical distribution |
|---|
| 33 | 34 | | system safety, liquefied petroleum gas storage and dispensing |
|---|
| 34 | 35 | | safety, or fire protection only if the policy, rule, ordinance, or |
|---|
| 35 | 36 | | order does not impose standards more stringent than the standards |
|---|
| 36 | 37 | | imposed under Section 764.003. |
|---|
| 37 | 38 | | SECTION 2. Notwithstanding Chapter 764, Health and Safety |
|---|
| 38 | 39 | | Code, as added by this Act, a recreational vehicle park or |
|---|
| 39 | 40 | | campground to which that chapter applies operating on the effective |
|---|
| 40 | 41 | | date of this Act is not required to comply with that chapter before |
|---|
| 41 | 42 | | September 1, 2026. |
|---|
| 42 | 43 | | SECTION 3. This Act takes effect September 1, 2025. |
