68 AN ACT
79 relating to the prosecution of the offense of fraudulent use or
810 possession of credit card or debit card information.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter F, Chapter 13A, Code of Criminal
1113 Procedure, is amended by adding Article 13A.2551 to read as
1214 follows:
1315 Art. 13A.2551. FRAUDULENT USE OR POSSESSION OF CREDIT CARD
1416 OR DEBIT CARD INFORMATION. An offense under Section 32.315, Penal
1517 Code, may be prosecuted in any county in which the offense was
1618 committed or in the county of residence for any person whose credit
1719 card or debit card information was unlawfully obtained, possessed,
1820 transferred, or used by the defendant.
1921 SECTION 2. Article 38.19(a), Code of Criminal Procedure, is
2022 amended to read as follows:
2123 (a) This article applies to the trial of an offense under
2224 any of the following sections of the Penal Code:
2325 (1) Section 32.21 (Forgery);
2426 (2) Section 32.31 (Credit Card or Debit Card Abuse);
2527 [or]
2628 (3) Section 32.51 (Fraudulent Use or Possession of
2729 Identifying Information); or
2830 (4) Section 32.315 (Fraudulent Use or Possession of
2931 Credit Card or Debit Card Information).
3032 SECTION 3. The changes in law made by this Act apply only to
3133 a criminal proceeding that commences on or after the effective date
3234 of this Act. A criminal proceeding that commenced before the
3335 effective date of this Act is governed by the law in effect on the
3436 date the proceeding commenced, and the former law is continued in
3537 effect for that purpose.
3638 SECTION 4. This Act takes effect September 1, 2025.
