6	8		AN ACT
7	9		relating to the prosecution of the offense of fraudulent use or
8	10		possession of credit card or debit card information.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Subchapter F, Chapter 13A, Code of Criminal
11	13		Procedure, is amended by adding Article 13A.2551 to read as
12	14		follows:
13	15		Art. 13A.2551. FRAUDULENT USE OR POSSESSION OF CREDIT CARD
14	16		OR DEBIT CARD INFORMATION. An offense under Section 32.315, Penal
15	17		Code, may be prosecuted in any county in which the offense was
16	18		committed or in the county of residence for any person whose credit
17	19		card or debit card information was unlawfully obtained, possessed,
18	20		transferred, or used by the defendant.
19	21		SECTION 2. Article 38.19(a), Code of Criminal Procedure, is
20	22		amended to read as follows:
21	23		(a) This article applies to the trial of an offense under
22	24		any of the following sections of the Penal Code:
23	25		(1) Section 32.21 (Forgery);
24	26		(2) Section 32.31 (Credit Card or Debit Card Abuse);
25	27		[or]
26	28		(3) Section 32.51 (Fraudulent Use or Possession of
27	29		Identifying Information); or
28	30		(4) Section 32.315 (Fraudulent Use or Possession of
29	31		Credit Card or Debit Card Information).
30	32		SECTION 3. The changes in law made by this Act apply only to
31	33		a criminal proceeding that commences on or after the effective date
32	34		of this Act. A criminal proceeding that commenced before the
33	35		effective date of this Act is governed by the law in effect on the
34	36		date the proceeding commenced, and the former law is continued in
35	37		effect for that purpose.
36	38		SECTION 4. This Act takes effect September 1, 2025.
