12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 25.001, Education Code, is amended by | |
14 | 14 | adding Subsection (c-3) to read as follows: | |
15 | 15 | (c-3) Notwithstanding Subsections (a) and (b), the board of | |
16 | 16 | trustees of a school district may adopt a policy to allow a person | |
17 | 17 | whose parent or guardian is an active-duty member of a foreign | |
18 | 18 | military force stationed in this state to establish the person's | |
19 | 19 | age for purposes of determining eligibility under those subsections | |
20 | 20 | by demonstrating that the person will turn the required age during | |
21 | 21 | the school year for which the person is seeking admission. | |
22 | 22 | SECTION 2. This Act applies beginning with the 2025-2026 | |
23 | 23 | school year. | |
24 | 24 | SECTION 3. This Act takes effect immediately if it receives | |
25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
28 | 28 | Act takes effect September 1, 2025. |
