88 AN ACT
99 relating to requiring the approval of the comptroller of public
1010 accounts before a state agency may accept federal money.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle C, Title 10, Government Code, is
1313 amended by adding Chapter 2118 to read as follows:
1414 CHAPTER 2118. REQUIREMENTS RELATING TO ACCEPTANCE OF FEDERAL MONEY
1515 BY STATE AGENCIES
1616 Sec. 2118.001. DEFINITION. In this chapter, "state agency"
1717 means an agency, department, commission, bureau, board, office,
1818 council, court, or other entity that is in any branch of state
1919 government and that is created by the constitution or a statute of
2020 this state. The term includes an institution of higher education as
2121 defined by Section 61.003, Education Code.
2222 Sec. 2118.002. REQUEST TO ACCEPT FEDERAL MONEY. (a) Except
2323 as provided by Subsection (c), a state agency may not accept federal
2424 money unless the agency first submits to the comptroller a request
2525 to accept the money and the comptroller approves the request.
2626 (b) A request by a state agency under Subsection (a) must
2727 include:
2828 (1) a detailed description of each condition or
2929 limitation that will be imposed on the agency if the agency accepts
3030 the money; and
3131 (2) an estimate of the cost to implement the
3232 conditions and limitations described by Subdivision (1).
3333 (c) A state agency is not required to submit a request to the
3434 comptroller to accept federal money if:
3535 (1) the agency previously submitted a request to
3636 accept federal money from the same source and for the same purposes
3737 to the comptroller under Subsection (a);
3838 (2) the comptroller approved the previously submitted
3939 request; and
4040 (3) no conditions or limitations other than those
4141 described in the previously submitted request will be imposed on
4242 the agency if the agency accepts the federal money, as determined by
4343 the agency.
4444 Sec. 2118.003. COMPTROLLER REVIEW. (a) The comptroller
4545 shall review and approve or deny a request received under Section
4646 2118.002 as soon as practicable after receipt.
4747 (b) The comptroller shall communicate to a state agency the
4848 approval or denial of a request submitted by the agency under
4949 Section 2118.002 before the passing of any applicable federal
5050 deadline regarding receipt of the money of which the comptroller is
5151 made aware in the request.
5252 Sec. 2118.004. COPY OF REQUEST FOR CERTAIN OFFICIALS. On
5353 receipt of a request under Section 2118.002, the comptroller shall
5454 provide a copy of the request to the governor, the lieutenant
5555 governor, the speaker of the house of representatives, and the
5656 chairs of the standing legislative committees with primary
5757 jurisdiction over appropriations.
5858 Sec. 2118.005. RULES. The comptroller shall adopt rules
5959 necessary to administer this chapter, including a rule prescribing
6060 the form to be used by a state agency for purposes of making a
6161 request under Section 2118.002.
6262 SECTION 2. Chapter 2118, Government Code, as added by this
6363 Act, applies only to federal money made available for receipt by a
6464 state agency on or after the effective date of this Act.
6565 SECTION 3. This Act takes effect September 1, 2025.
