| 10 | 10 | | certain local governments and airport governing boards. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 22.028, Transportation Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | Sec. 22.028. CONFIDENTIALITY OF CERTAIN INFORMATION |
|---|
| 15 | 15 | | COLLECTED BY LOCAL GOVERNMENT. Personal identifying information |
|---|
| 16 | 16 | | collected by a local government is confidential and not subject to |
|---|
| 17 | 17 | | disclosure under Chapter 552, Government Code, if the information |
|---|
| 18 | 18 | | collected is in relation to a person's use of an airport [parking] |
|---|
| 19 | 19 | | facility that includes: |
|---|
| 20 | 20 | | (1) the person's name, address, e-mail address, phone |
|---|
| 21 | 21 | | number, and zip code; |
|---|
| 22 | 22 | | (2) the person's license plate number, toll tag |
|---|
| 23 | 23 | | number, and credit, debit, or other payment card number; [or] |
|---|
| 24 | 24 | | (3) the dates the person's vehicle was parked at a |
|---|
| 25 | 25 | | parking [the] facility, the date the person's vehicle exited the |
|---|
| 26 | 26 | | parking facility, and the amount the person paid to park in the |
|---|
| 27 | 27 | | parking facility; |
|---|
| 28 | 28 | | (4) the person's profile name associated with a |
|---|
| 29 | 29 | | purchase or other online or in-person activity; |
|---|
| 30 | 30 | | (5) the person's travel dates and flight information; |
|---|
| 31 | 31 | | (6) the dates, times, and amounts of any purchase made |
|---|
| 32 | 32 | | by the person; or |
|---|
| 33 | 33 | | (7) the person's airport lounge memberships and |
|---|
| 34 | 34 | | trusted traveler information. |

| 35 | 35 | | SECTION 2. Section 22.091, Transportation Code, is amended |
|---|
| 36 | 36 | | to read as follows: |
|---|
| 37 | 37 | | Sec. 22.091. CONFIDENTIALITY OF CERTAIN INFORMATION |

| 38 | 38 | | COLLECTED BY JOINT BOARD. Personal identifying information |
|---|
| 39 | 39 | | collected by a joint board for which the constituent agencies are |
|---|
| 40 | 40 | | populous home-rule municipalities is confidential and not subject |
|---|
| 41 | 41 | | to disclosure under Chapter 552, Government Code, if the |
|---|
| 42 | 42 | | information collected is in relation to: |
|---|
| 43 | 43 | | (1) a commercial online payment system and includes a |
|---|
| 44 | 44 | | person's: |
|---|
| 45 | 45 | | (A) name, address, e-mail address, or phone |
|---|
| 46 | 46 | | number; |
|---|
| 47 | 47 | | (B) account number, password, payment |
|---|
| 48 | 48 | | transaction activity, toll or charge record, or credit, debit, or |
|---|
| 49 | 49 | | other payment card number; or |
|---|
| 50 | 50 | | (C) other personal financial information; or |
|---|
| 51 | 51 | | (2) a person's use of an airport [parking] facility |
|---|
| 52 | 52 | | that includes: |
|---|
| 53 | 53 | | (A) the person's name, address, e-mail address, |
|---|
| 54 | 54 | | phone number, and zip code; |
|---|
| 55 | 55 | | (B) the person's license plate number, toll tag |
|---|
| 56 | 56 | | number, and credit, debit, or other payment card number; [or] |
|---|
| 57 | 57 | | (C) the dates the person's vehicle was parked at |
|---|
| 58 | 58 | | a parking [the] facility, the date the person's vehicle exited the |
|---|
| 59 | 59 | | parking facility, and the amount the person paid to park in the |
|---|

| 61 | 61 | | (D) the person's profile name associated with a |
|---|
| 62 | 62 | | purchase or other online or in-person activity; |
|---|
| 63 | 63 | | (E) the person's travel dates and flight |
|---|
| 64 | 64 | | information; |
|---|
| 65 | 65 | | (F) the dates, times, and amounts of any purchase |
|---|
| 66 | 66 | | made by the person; or |
|---|
| 67 | 67 | | (G) the person's airport lounge memberships and |
|---|
| 68 | 68 | | trusted traveler information. |

| 69 | 69 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 70 | 70 | | a request for public information received by a governmental body or |
|---|
| 71 | 71 | | an officer for public information on or after the effective date of |
|---|
| 72 | 72 | | this Act. |
|---|
| 73 | 73 | | SECTION 4. This Act takes effect September 1, 2025. |
