77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the temperature at which certain facilities operated by
1010 the Texas Department of Criminal Justice are maintained.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 501, Government Code, is
1313 amended by adding Sections 501.028 and 501.029 to read as follows:
1414 Sec. 501.028. TEMPERATURE REQUIREMENTS AT DEPARTMENT
1515 FACILITIES. (a) The department shall ensure that the temperature
1616 in each facility operated by the department and used to house
1717 inmates or in which department staff regularly work is maintained
1818 at not less than 65 degrees Fahrenheit or more than 85 degrees
1919 Fahrenheit.
2020 (b) The department shall install and maintain an electronic
2121 temperature gauge in the following areas of each facility described
2222 by Subsection (a):
2323 (1) hospitals;
2424 (2) visiting areas;
2525 (3) housing or dormitory areas;
2626 (4) trustee areas;
2727 (5) areas used for medical treatment or care,
2828 including areas used for dispensing medication to inmates;
2929 (6) kitchens or dining areas;
3030 (7) food preparation areas;
3131 (8) community areas, including dayrooms;
3232 (9) laundry areas;
3333 (10) areas used for work stations;
3434 (11) indoor recreational areas, including gymnasiums;
3535 (12) restroom and shower areas and other areas related
3636 to inmate hygiene;
3737 (13) administrative areas;
3838 (14) correctional officer stations, including guard
3939 post areas;
4040 (15) commissary areas;
4141 (16) areas used for programmatic, educational, or
4242 vocational purposes;
4343 (17) chapels or churches;
4444 (18) libraries; and
4545 (19) maintenance areas.
4646 (c) The department shall:
4747 (1) maintain a log of the temperatures recorded by
4848 each electronic temperature gauge under Subsection (b) on an hourly
4949 basis in an electronic format; and
5050 (2) publish the log, at least quarterly, on the
5151 department's publicly accessible Internet website.
5252 Sec. 501.029. REPORT REGARDING AIR CONDITIONING. Not later
5353 than December 1 of each year, the department shall submit to the
5454 governor, the lieutenant governor, the speaker of the house of
5555 representatives, and each standing committee of the legislature
5656 with primary jurisdiction over the department a report regarding
5757 air conditioning in facilities operated by the department and used
5858 to house inmates or in which department staff regularly work. The
5959 report must include the following information for the preceding
6060 12-month period:
6161 (1) the number of facilities in which the air
6262 conditioning system has failed;
6363 (2) the number of incidents in which the air
6464 conditioning in a facility was not operational and the reason for
6565 each incident;
6666 (3) the number of incidents in which the temperature
6767 was not maintained at the temperature range required under Section
6868 501.028(a) and the reason for each incident;
6969 (4) for each incident described by Subdivision (2)
7070 that was due to an equipment malfunction, a summary of the steps
7171 taken by the department to address the malfunction and ensure the
7272 well-being of inmates and staff at the facility; and
7373 (5) for each incident described by Subdivision (3), a
7474 summary of the steps taken by the department to address the cause of
7575 the incident and ensure the well-being of inmates and staff at the
7676 facility.
7777 SECTION 2. (a) The Texas Department of Criminal Justice is
7878 not required to fully comply with the requirements of Section
7979 501.028, Government Code, as added by this Act, until September 1,
8080 2026.
8181 (b) Not later than September 1, 2026, the Texas Department
8282 of Criminal Justice shall submit to the governor, the lieutenant
8383 governor, the speaker of the house of representatives, and each
8484 standing committee of the legislature with primary jurisdiction
8585 over the department a report regarding the department's progress
8686 toward complying with Section 501.028, Government Code, as added by
8787 this Act, in all facilities to which that section applies.
8888 (c) The Texas Department of Criminal Justice shall submit
8989 the first report required by Section 501.029, Government Code, as
9090 added by this Act, not later than December 1, 2027.
9191 SECTION 3. (a) Except as provided by Subsection (b) of this
9292 section, this Act takes effect immediately if it receives a vote of
9393 two-thirds of all the members elected to each house, as provided by
9494 Section 39, Article III, Texas Constitution. If this Act does not
9595 receive the vote necessary for immediate effect, this Act takes
9696 effect September 1, 2025.
9797 (b) Section 501.029, Government Code, as added by this Act,
9898 takes effect September 1, 2027.
