11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter U, Chapter 51, Education Code, is | |
13 | 13 | amended by adding Section 51.811 to read as follows: | |
14 | 14 | Sec. 51.811. LIMITATION ON ADMISSION OF NONRESIDENT | |
15 | 15 | STUDENTS. (a) In this section, "institution of higher education" | |
16 | 16 | has the meaning assigned by Section 61.003. | |
17 | 17 | (b) Notwithstanding any other provision of this subchapter | |
18 | 18 | or Subchapter W but subject to Section 51.803(j), an institution of | |
19 | 19 | higher education may not offer admission to undergraduate or | |
20 | 20 | graduate students who are not residents of this state for an | |
21 | 21 | academic year in excess of the number required to fill 15 percent of | |
22 | 22 | the institution's enrollment capacity designated for undergraduate | |
23 | 23 | or graduate students, as applicable, for that academic year. | |
24 | 24 | SECTION 2. Section 51.811, Education Code, as added by this | |
25 | 25 | Act, applies beginning with admissions for the 2026-2027 academic | |
26 | 26 | year. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2025. |
