88 AN ACT
99 relating to school marshals, including eligibility for appointment
1010 as a school marshal, and licensure and training requirements.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 2A.008(b), Code of Criminal Procedure,
1313 is amended to read as follows:
1414 (b) A person may not serve as a school marshal unless the
1515 person is:
1616 (1) either:
1717 (A) licensed under Section 1701.260, Occupations
1818 Code; or
1919 (B) a volunteer of a school district,
2020 open-enrollment charter school, private school, or public junior
2121 college who is:
2222 (i) an honorably discharged veteran or
2323 active duty member of the armed forces of the United States;
2424 (ii) a peace officer;
2525 (iii) a reserve law enforcement officer, as
2626 defined by Section 1701.001, Occupations Code; or
2727 (iv) a retired peace officer, as defined by
2828 Section 1701.3161, Occupations Code; and
2929 (2) appointed by:
3030 (A) the board of trustees of a school district or
3131 the governing body of an open-enrollment charter school under
3232 Section 37.0811, Education Code;
3333 (B) the governing body of a private school under
3434 Section 37.0813, Education Code; or
3535 (C) the governing board of a public junior
3636 college under Section 51.220, Education Code.
3737 SECTION 2. Section 37.0811, Education Code, is amended by
3838 amending Subsections (b), (f), and (h) and adding Subsection (b-1)
3939 to read as follows:
4040 (b) The board of trustees of a school district or the
4141 governing body of an open-enrollment charter school may select for
4242 appointment as a school marshal under this section an applicant who
4343 is either:
4444 (1) an employee of the school district or
4545 open-enrollment charter school and certified as eligible for
4646 appointment under Section 1701.260, Occupations Code; or
4747 (2) a school district or open-enrollment charter
4848 school volunteer who is:
4949 (A) an honorably discharged veteran or active
5050 duty member of the armed forces of the United States;
5151 (B) a peace officer;
5252 (C) a reserve law enforcement officer, as defined
5353 by Section 1701.001, Occupations Code; or
5454 (D) a retired peace officer, as defined by
5555 Section 1701.3161, Occupations Code.
5656 (b-1) The board of trustees of a school district or the
5757 governing body of an open-enrollment charter school may, but shall
5858 not be required to, reimburse the amount paid by an [the] applicant
5959 for appointment as a school marshal to participate in the training
6060 program under Section 1701.260, Occupations Code [that section].
6161 (f) A person's [school district or charter school
6262 employee's] status as a school marshal becomes inactive on:
6363 (1) expiration of the person's [employee's] school
6464 marshal license under Section 1701.260, Occupations Code, if the
6565 person is required to hold that license as a condition of the
6666 person's school marshal license;
6767 (2) suspension or revocation of the person's
6868 [employee's] license to carry a handgun issued under Subchapter H,
6969 Chapter 411, Government Code, if the person is required to hold that
7070 license as a condition of the person's school marshal license under
7171 Section 1701.260, Occupations Code;
7272 (3) termination of the person's [employee's]
7373 employment or volunteer service, as applicable, with the district
7474 or charter school; or
7575 (4) notice from the board of trustees of the district
7676 or the governing body of the charter school that the person's
7777 [employee's] services as school marshal are no longer required.
7878 (h) If a parent or guardian of a student enrolled at a school
7979 inquires in writing, the school district or open-enrollment charter
8080 school shall provide the parent or guardian written notice
8181 indicating whether any person [employee of the school] is currently
8282 appointed a school marshal. The notice may not disclose
8383 information that is confidential under Subsection (g).
8484 SECTION 3. Sections 37.0813(b), (f), and (h), Education
8585 Code, are amended to read as follows:
8686 (b) The governing body of a private school may select for
8787 appointment as a school marshal under this section an applicant who
8888 is either:
8989 (1) an employee of the school and certified as
9090 eligible for appointment under Section 1701.260, Occupations Code;
9191 or
9292 (2) a school volunteer who is:
9393 (A) an honorably discharged veteran or active
9494 duty member of the armed forces of the United States;
9595 (B) a peace officer;
9696 (C) a reserve law enforcement officer, as defined
9797 by Section 1701.001, Occupations Code; or
9898 (D) a retired peace officer, as defined by
9999 Section 1701.3161, Occupations Code.
100100 (f) A person's [private school employee's] status as a
101101 school marshal becomes inactive on:
102102 (1) expiration of the person's [employee's] school
103103 marshal license under Section 1701.260, Occupations Code, if the
104104 person is required to hold that license as a condition of the
105105 person's school marshal license;
106106 (2) suspension or revocation of the person's
107107 [employee's] license to carry a handgun issued under Subchapter H,
108108 Chapter 411, Government Code, if the person is required to hold that
109109 license as a condition of the person's school marshal license under
110110 Section 1701.260, Occupations Code;
111111 (3) termination of the person's [employee's]
112112 employment or volunteer service, as applicable, with the private
113113 school; or
114114 (4) notice from the governing body that the person's
115115 [employee's] services as school marshal are no longer required.
116116 (h) If a parent or guardian of a student enrolled at a
117117 private school inquires in writing, the school shall provide the
118118 parent or guardian written notice indicating whether any person
119119 [employee of the school] is currently appointed a school marshal.
120120 The notice may not disclose information that is confidential under
121121 Subsection (g).
122122 SECTION 4. Section 51.220, Education Code, is amended by
123123 amending Subsections (c), (g), and (i) and adding Subsection (c-1)
124124 to read as follows:
125125 (c) The governing board of a public junior college may
126126 select for appointment as a school marshal under this section an
127127 applicant who is either:
128128 (1) an employee of the public junior college and
129129 certified as eligible for appointment under Section 1701.260,
130130 Occupations Code; or
131131 (2) a volunteer of the public junior college who is:
132132 (A) an honorably discharged veteran or active
133133 duty member of the armed forces of the United States;
134134 (B) a peace officer;
135135 (C) a reserve law enforcement officer, as defined
136136 by Section 1701.001, Occupations Code; or
137137 (D) a retired peace officer, as defined by
138138 Section 1701.3161, Occupations Code.
139139 (c-1) The governing board of a public junior college may,
140140 but shall not be required to, reimburse the amount paid by an [the]
141141 applicant for appointment as a school marshal to participate in the
142142 training program under Section 1701.260, Occupations Code [that
143143 section].
144144 (g) A person's [public junior college employee's] status as
145145 a school marshal becomes inactive on:
146146 (1) expiration of the person's [employee's] school
147147 marshal license under Section 1701.260, Occupations Code, if the
148148 person is required to hold that license as a condition of the
149149 person's school marshal license;
150150 (2) suspension or revocation of the person's
151151 [employee's] license to carry a concealed handgun issued under
152152 Subchapter H, Chapter 411, Government Code, if the person is
153153 required to hold that license as a condition of the person's school
154154 marshal license under Section 1701.260, Occupations Code;
155155 (3) termination of the person's [employee's]
156156 employment or volunteer service, as applicable, with the public
157157 junior college; or
158158 (4) notice from the governing board of the public
159159 junior college that the person's [employee's] services as school
160160 marshal are no longer required.
161161 (i) If a parent or guardian of a student enrolled at a public
162162 junior college inquires in writing, the governing board of the
163163 public junior college shall provide the parent or guardian written
164164 notice indicating whether any person [employee of the public junior
165165 college] is currently appointed a school marshal. The notice may
166166 not disclose information that is confidential under Subsection (h).
167167 SECTION 5. Section 1701.001(8), Occupations Code, is
168168 amended to read as follows:
169169 (8) "School marshal" means a person who:
170170 (A) is appointed to serve as a school marshal by:
171171 (i) the board of trustees of a school
172172 district or the governing body of an open-enrollment charter school
173173 under Section 37.0811, Education Code;
174174 (ii) the governing body of a private school
175175 under Section 37.0813, Education Code; or
176176 (iii) the governing board of a public
177177 junior college under Section 51.220, Education Code;
178178 (B) is:
179179 (i) licensed under Section 1701.260;
180180 (ii) an honorably discharged veteran or
181181 active duty member of the armed forces of the United States;
182182 (iii) a peace officer;
183183 (iv) a reserve law enforcement officer; or
184184 (v) a retired peace officer, as defined by
185185 Section 1701.3161; and
186186 (C) has powers and duties described by Article
187187 2A.008, Code of Criminal Procedure.
188188 SECTION 6. Section 1701.260, Occupations Code, is amended
189189 by amending Subsections (a), (a-1), (b), (i), and (j) and adding
190190 Subsection (a-2) to read as follows:
191191 (a) The commission shall establish and maintain a training
192192 program open to any employee or volunteer of a school district,
193193 open-enrollment charter school, private school, or public junior
194194 college:
195195 (1) for an employee, who holds a license to carry a
196196 handgun issued under Subchapter H, Chapter 411, Government Code; or
197197 (2) for a volunteer, who is:
198198 (A) an honorably discharged veteran or active
199199 duty member of the armed forces of the United States;
200200 (B) a peace officer;
201201 (C) a reserve law enforcement officer, as defined
202202 by Section 1701.001; or
203203 (D) a retired peace officer, as defined by
204204 Section 1701.3161.
205205 (a-1) The training under the training program may be
206206 conducted only by the commission staff or a provider approved by the
207207 commission.
208208 (a-2) [(a-1)] In this section, "private school" has the
209209 meaning assigned by Article 2A.008, Code of Criminal Procedure.
210210 (b) The commission shall collect from each person who
211211 participates in the training program identifying information that
212212 includes the person's name, the person's date of birth, the license
213213 number of the license issued to the person under Subchapter H,
214214 Chapter 411, Government Code, and the address of the person's place
215215 of employment or volunteer service, as applicable.
216216 (i) The commission shall revoke the [a person's] school
217217 marshal license of a person described by Subsection (a)(1) if the
218218 commission is notified by the Department of Public Safety that the
219219 person's license to carry a handgun issued under Subchapter H,
220220 Chapter 411, Government Code, has been suspended or revoked. A
221221 person whose school marshal license is revoked may obtain
222222 recertification by:
223223 (1) furnishing proof to the commission that the
224224 person's handgun license has been reinstated; and
225225 (2) completing the initial training under Subsection
226226 (c) to the satisfaction of the commission staff, paying the fee for
227227 the training, and demonstrating psychological fitness on the
228228 psychological examination described in Subsection (d).
229229 (j) The commission shall submit the identifying information
230230 collected under Subsection (b) for each person licensed by the
231231 commission under this section to:
232232 (1) the director of the Department of Public Safety;
233233 (2) the [person's employer, if the person is employed
234234 by a] school district, open-enrollment charter school, private
235235 school, or public junior college at which the person is employed or
236236 volunteers;
237237 (3) the chief law enforcement officer of the local
238238 municipal law enforcement agency if the person is employed or
239239 volunteers at a campus of a school district, open-enrollment
240240 charter school, private school, or public junior college located
241241 within a municipality;
242242 (4) the sheriff of the county if the person is employed
243243 or volunteers at a campus of a school district, open-enrollment
244244 charter school, private school, or public junior college that is
245245 not located within a municipality; and
246246 (5) the chief administrator of any peace officer
247247 commissioned under Section 37.081 or 51.203, Education Code, if the
248248 person is employed or volunteers at a school district or public
249249 junior college that has commissioned a peace officer under either
250250 section.
251251 SECTION 7. This Act takes effect September 1, 2025.
