9 | 9 | | relating to the regulation of manufactured home rental communities |

10 | 10 | | located in certain counties. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 232.007, Local Government Code, is |
---|
13 | 13 | | amended by adding Subsection (c-1) and amending Subsection (e) to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | (c-1) This subsection applies only to a county that has a |
---|
16 | 16 | | population of more than 370,000, borders the Gulf of Mexico, and is |
---|
17 | 17 | | adjacent to a county with a population of more than 3.3 million. |
---|
18 | 18 | | Notwithstanding Subsection (d) and after complying with the |
---|
19 | 19 | | procedures described by Subsection (c), the commissioners court of |
---|
20 | 20 | | a county may establish additional minimum infrastructure standards |
---|
21 | 21 | | for manufactured home rental communities located in the |
---|
22 | 22 | | unincorporated area of the county. The standards established under |
---|
23 | 23 | | this subsection may include only: |
---|
24 | 24 | | (1) reasonable lot or space size requirements; |
---|
25 | 25 | | (2) reasonable road width requirements based on the |
---|
26 | 26 | | lot or space density of the manufactured home rental community; and |
---|
27 | 27 | | (3) reasonable ingress and egress access based on the |
---|
28 | 28 | | lot or space density of the manufactured home rental community. |
---|
29 | 29 | | (e) If the commissioners court adopts minimum |
---|
30 | 30 | | infrastructure standards for manufactured home rental communities, |
---|
31 | 31 | | the owner of land located outside the limits of a municipality who |
---|
32 | 32 | | intends to use the land for a manufactured home rental community |
---|
33 | 33 | | must have an infrastructure development plan prepared that complies |
---|
34 | 34 | | with the minimum infrastructure standards adopted by the |
---|
35 | 35 | | commissioners court under this section [Subsection (c)]. |
---|
36 | 36 | | SECTION 2. The change in law made by this Act applies only |
---|
37 | 37 | | to a manufactured home rental community for which construction |
---|
38 | 38 | | begins on or after the date minimum infrastructure standards |
---|
39 | 39 | | adopted by the commissioners court as provided by Section |
---|
40 | 40 | | 232.007(c-1), Local Government Code, as added by this Act, take |
---|
41 | 41 | | effect. |
---|
42 | 42 | | SECTION 3. This Act takes effect September 1, 2025. |
