89R2070 MP-D By: Vasut H.B. No. 328 A BILL TO BE ENTITLED AN ACT relating to the regulation of manufactured home rental communities located in certain counties. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 232.007, Local Government Code, is amended by adding Subsection (c-1) and amending Subsection (e) to read as follows: (c-1) This subsection applies only to a county that has a population of more than 370,000, borders the Gulf of Mexico, and is adjacent to a county with a population of more than 3.3 million. Notwithstanding Subsection (d) and after complying with the procedures described by Subsection (c), the commissioners court of a county may establish additional minimum infrastructure standards for manufactured home rental communities located in the unincorporated area of the county. The standards established under this subsection may include only: (1) reasonable lot or space size requirements; (2) reasonable road width requirements based on the lot or space density of the manufactured home rental community; and (3) reasonable ingress and egress access based on the lot or space density of the manufactured home rental community. (e) If the commissioners court adopts minimum infrastructure standards for manufactured home rental communities, the owner of land located outside the limits of a municipality who intends to use the land for a manufactured home rental community must have an infrastructure development plan prepared that complies with the minimum infrastructure standards adopted by the commissioners court under this section [Subsection (c)]. SECTION 2. The change in law made by this Act applies only to a manufactured home rental community for which construction begins on or after the date minimum infrastructure standards adopted by the commissioners court as provided by Section 232.007(c-1), Local Government Code, as added by this Act, take effect. SECTION 3. This Act takes effect September 1, 2025.
