10 | 10 | | expenditures from the federal government. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter F, Chapter 401, Government Code, is |
---|
13 | 13 | | amended by adding Section 401.106 to read as follows: |
---|
14 | 14 | | Sec. 401.106. RECOVERY OF CERTAIN BORDER SECURITY |
---|
15 | 15 | | EXPENDITURES. (a) The governor may submit to the United States |
---|
16 | 16 | | Congress an application for reimbursement requesting payment for |
---|
17 | 17 | | expenses incurred by this state during a period specified in the |
---|
18 | 18 | | application for activities related to securing the southern |
---|
19 | 19 | | international border of the United States of America. |
---|
20 | 20 | | (b) The application for reimbursement must include the |
---|
21 | 21 | | amount of expenses incurred by this state during the period |
---|
22 | 22 | | specified in the application for which this state seeks |
---|
23 | 23 | | reimbursement and clearly provide that payment in full is due from |
---|
24 | 24 | | the federal government as soon as practicable. |
---|
25 | 25 | | (c) If the total amount requested in an application |
---|
26 | 26 | | submitted under Subsection (a) is not paid within a reasonable |
---|
27 | 27 | | period prescribed by Subsection (b), the attorney general may bring |
---|
28 | 28 | | an action in the name of the state against the appropriate agency of |
---|
29 | 29 | | the federal government to recover the amount due as stated in the |
---|
30 | 30 | | application or any part of that amount that remains unpaid. |
---|
31 | 31 | | (d) Any amount received from the federal government under |
---|
32 | 32 | | this section shall be deposited in the state treasury to the credit |
---|
33 | 33 | | of the general revenue fund. |
---|
34 | 34 | | (e) Notwithstanding any other provision of this section, |
---|
35 | 35 | | the initial application for reimbursement submitted by the governor |
---|
36 | 36 | | under Subsection (a) must include a request for payment of at least |
---|
37 | 37 | | the following amounts: |
---|
38 | 38 | | (1) $4,720,000,000 for the state fiscal biennium |
---|
39 | 39 | | ending August 31, 2023; and |
---|
40 | 40 | | (2) $6,540,000,000 for the state fiscal biennium |
---|
41 | 41 | | ending August 31, 2025. |
---|
42 | 42 | | (f) Subsection (e) and this subsection expire August 31, |
---|
43 | 43 | | 2026. |
---|
44 | 44 | | SECTION 2. This Act takes effect immediately if it receives |
---|
45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
---|
46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
---|
48 | 48 | | Act takes effect September 1, 2025. |
