77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the recovery of certain state border security
1010 expenditures from the federal government.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 401, Government Code, is
1313 amended by adding Section 401.106 to read as follows:
1414 Sec. 401.106. RECOVERY OF CERTAIN BORDER SECURITY
1515 EXPENDITURES. (a) The governor may submit to the United States
1616 Congress an application for reimbursement requesting payment for
1717 expenses incurred by this state during a period specified in the
1818 application for activities related to securing the southern
1919 international border of the United States of America.
2020 (b) The application for reimbursement must include the
2121 amount of expenses incurred by this state during the period
2222 specified in the application for which this state seeks
2323 reimbursement and clearly provide that payment in full is due from
2424 the federal government as soon as practicable.
2525 (c) If the total amount requested in an application
2626 submitted under Subsection (a) is not paid within a reasonable
2727 period prescribed by Subsection (b), the attorney general may bring
2828 an action in the name of the state against the appropriate agency of
2929 the federal government to recover the amount due as stated in the
3030 application or any part of that amount that remains unpaid.
3131 (d) Any amount received from the federal government under
3232 this section shall be deposited in the state treasury to the credit
3333 of the general revenue fund.
3434 (e) Notwithstanding any other provision of this section,
3535 the initial application for reimbursement submitted by the governor
3636 under Subsection (a) must include a request for payment of at least
3737 the following amounts:
3838 (1) $4,720,000,000 for the state fiscal biennium
3939 ending August 31, 2023; and
4040 (2) $6,540,000,000 for the state fiscal biennium
4141 ending August 31, 2025.
4242 (f) Subsection (e) and this subsection expire August 31,
4343 2026.
4444 SECTION 2. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2025.
