| 9 | 9 | | relating to certain memorial markers and designations on highways |
|---|
| 10 | 10 | | in this state. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Section 201.911, Transportation Code, is amended |
|---|
| 13 | 13 | | by amending Subsections (a) and (c) and adding Subsection (c-1) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (a) In this section, "victim" means a person killed in a |
|---|
| 16 | 16 | | highway collision while operating or riding on a motorcycle. The |
|---|
| 17 | 17 | | term does not include a person who was under the influence of |
|---|
| 18 | 18 | | alcohol or a controlled substance at the time of the collision. |
|---|
| 19 | 19 | | (c) A sign designed and posted under this section shall |
|---|
| 20 | 20 | | include: |
|---|
| 21 | 21 | | (1) a motorcyclist safety message selected from the |
|---|
| 22 | 22 | | options provided by commission rule under Subsection (c-1) [red |
|---|
| 23 | 23 | | cross]; |
|---|
| 24 | 24 | | (2) the phrase "In Memory Of" and the name of one or |
|---|
| 25 | 25 | | more victims in accordance with the commission rule; and |
|---|
| 26 | 26 | | (3) the date of the collision that resulted in the |
|---|
| 27 | 27 | | victim's death. |
|---|
| 28 | 28 | | (c-1) The commission by rule shall develop motorcyclist |
|---|
| 29 | 29 | | safety messages that may be used on the memorial signs under this |
|---|
| 30 | 30 | | section. |
|---|
| 31 | 31 | | SECTION 2. Section 225.021, Transportation Code, is amended |
|---|
| 32 | 32 | | by amending Subsection (a) and adding Subsection (e) to read as |
|---|
| 33 | 33 | | follows: |
|---|
| 34 | 34 | | (a) Subject to Subsection (e), the [The] department shall |
|---|
| 35 | 35 | | repair and replace each marker required by this subchapter and |
|---|
| 36 | 36 | | maintain the grounds for the marker. |
|---|
| 37 | 37 | | (e) The department may not repair or replace a marker after |
|---|
| 38 | 38 | | the 10th anniversary of the effective date of the provision |
|---|
| 39 | 39 | | requiring the marker to be erected unless a grant or donation of |
|---|
| 40 | 40 | | funds is made to the department to cover the cost of the repair or |
|---|
| 41 | 41 | | replacement of the marker. This subsection applies only to a |
|---|
| 42 | 42 | | provision of this subchapter enacted after January 1, 2025, that |
|---|
| 43 | 43 | | requires the erection of a marker. |
|---|
| 44 | 44 | | SECTION 3. (a) Not later than December 1, 2025, the Texas |
|---|
| 45 | 45 | | Transportation Commission shall adopt the rules required by Section |
|---|
| 46 | 46 | | 201.911(c-1), Transportation Code, as added by this Act. |
|---|
| 47 | 47 | | (b) Notwithstanding Section 201.911, Transportation Code, |
|---|
| 48 | 48 | | as amended by this Act, the Texas Department of Transportation is |
|---|
| 49 | 49 | | not required to comply with the changes in law made by this Act |
|---|
| 50 | 50 | | before March 1, 2026. |
|---|
| 51 | 51 | | SECTION 4. This Act takes effect September 1, 2025. |
