810 AN ACT
911 relating to the participation of electric vehicles in the ERCOT
1012 market.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is
1315 amended by adding Section 39.9161 to read as follows:
1416 Sec. 39.9161. INTERCONNECTION AND AGGREGATION OF ELECTRIC
1517 VEHICLES. (a) In this section:
1618 (1) "Electric vehicle" has the meaning assigned by
1719 Section 42.0102.
1820 (2) "Interconnection" means the right of an electric
1921 vehicle owner to physically connect the electric vehicle to an
2022 electricity distribution system and the technical requirements,
2123 rules, or processes for the connection.
2224 (b) The commission by rule may establish safety, technical,
2325 and performance standards for the interconnection of electric
2426 vehicles in the ERCOT power region. In adopting the rules, the
2527 commission shall ensure that the standards do not conflict with
26- applicable standards published by the Underwriters Laboratories
27- and the Institute of Electrical and Electronics Engineers, with the
28- National Electrical Code, or with the National Electrical Safety
29- Code.
30- (c) The commission by rule may allow an electric vehicle
31- owner to:

29+ the National Electrical Code, the National Electrical Safety Code,
30+ and the Institute of Electrical and Electronics Engineers.
31+ (c) The commission by rule may establish a program to allow
32+ an electric vehicle owner to:
3233 (1) make electricity stored by the electric vehicle
3334 available for sale in the wholesale energy and ancillary services
3435 markets through a registered aggregator or load serving entity; and
3536 (2) participate in ERCOT market mechanisms, including
3637 ancillary services, virtual power plant programs, and aggregate
3738 distributed energy resources programs, through an aggregation
3839 described by Subdivision (1).
3940 SECTION 2. This Act takes effect September 1, 2025.
