57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to the availability of certain working papers and
810 electronic communications of certain administrative law judges and
911 technical examiners under the public information law.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 552.144, Government Code, is amended to
1214 read as follows:
1315 Sec. 552.144. EXCEPTION: WORKING PAPERS AND ELECTRONIC
1416 COMMUNICATIONS OF ADMINISTRATIVE LAW JUDGES AND TECHNICAL
1517 EXAMINERS AT STATE OFFICE OF ADMINISTRATIVE HEARINGS AND RAILROAD
1618 COMMISSION. The following working papers and electronic
1719 communications of an administrative law judge at the State Office
1820 of Administrative Hearings or of a technical examiner or
1921 administrative law judge at the Railroad Commission of Texas are
2022 excepted from the requirements of Section 552.021:
2123 (1) notes and electronic communications recording the
2224 observations, thoughts, questions, deliberations, or impressions
2325 of an administrative law judge or a technical examiner;
2426 (2) drafts of a proposal for decision;
2527 (3) drafts of orders made in connection with
2628 conducting contested case hearings; and
2729 (4) drafts of orders made in connection with
2830 conducting alternative dispute resolution procedures.
2931 SECTION 2. The changes in law made by this Act apply only to
3032 a request for public information received by a governmental body or
3133 an officer for public information on or after the effective date of
3234 this Act.
3335 SECTION 3. This Act takes effect September 1, 2025.
