| 9 | 9 | | ethnicity by the Texas Education Agency. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 7, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 7.038 to read as follows: |
|---|
| 13 | 13 | | Sec. 7.038. COLLECTION AND REPORTING OF CERTAIN DEMOGRAPHIC |
|---|
| 14 | 14 | | INFORMATION. (a) In collecting and disaggregating data by race or |
|---|
| 15 | 15 | | ethnicity for purposes of a reporting requirement related to |
|---|
| 16 | 16 | | academic achievement, graduation rates, attendance rates, |
|---|
| 17 | 17 | | languages spoken at home, or access to educational resources, the |
|---|
| 18 | 18 | | agency shall require the following categories to be used: |
|---|
| 19 | 19 | | (1) American Indian or Alaska Native, including |
|---|
| 20 | 20 | | subcategories including all Indian tribes or bands which are |
|---|
| 21 | 21 | | recognized by federal law and located in this state; |
|---|
| 22 | 22 | | (2) Asian, including the following subcategories: |
|---|
| 23 | 23 | | (A) Asian Indian; |
|---|
| 24 | 24 | | (B) Chinese; |
|---|
| 25 | 25 | | (C) Filipino; |
|---|
| 26 | 26 | | (D) Korean; |
|---|
| 27 | 27 | | (E) Pakistani; |
|---|
| 28 | 28 | | (F) Vietnamese; and |
|---|
| 29 | 29 | | (G) other; |
|---|
| 30 | 30 | | (3) Black or African American, including the following |
|---|
| 31 | 31 | | subcategories: |
|---|
| 32 | 32 | | (A) African American; |
|---|
| 33 | 33 | | (B) Ethiopian; |
|---|
| 34 | 34 | | (C) Haitian; |

| 74 | 74 | | (b) In collecting demographic data under this section, the |
|---|
| 75 | 75 | | agency shall provide the option to: |
|---|
| 76 | 76 | | (1) select more than one category for race or ethnic |
|---|
| 77 | 77 | | origin; and |
|---|
| 78 | 78 | | (2) select more than one subcategory for race or |
|---|
| 79 | 79 | | ethnic origin. |
|---|
| 80 | 80 | | (c) The agency shall post in a publicly available location |
|---|
| 81 | 81 | | on the agency's Internet website data collected under a reporting |
|---|
| 82 | 82 | | requirement described by Subsection (a) in a manner that: |
|---|
| 83 | 83 | | (1) is disaggregated by the categories and |
|---|
| 84 | 84 | | subcategories of race and ethnicity provided by Subsection (a), |
|---|
| 85 | 85 | | subject to Subdivision (3); |
|---|
| 86 | 86 | | (2) is easily accessible and readily understandable; |
|---|
| 87 | 87 | | and |
|---|
| 88 | 88 | | (3) complies with federal law regarding |
|---|
| 89 | 89 | | confidentiality of student educational information, including the |
|---|
| 90 | 90 | | Family Educational Rights and Privacy Act of 1974 (20 U.S.C. |
|---|
| 91 | 91 | | Section 1232g), and any state law relating to the privacy of student |
|---|
| 92 | 92 | | information. |
|---|
| 93 | 93 | | SECTION 2. Not later than the 2027-2028 school year, the |
|---|
| 94 | 94 | | Texas Education Agency shall revise the agency's reporting |
|---|
| 95 | 95 | | standards as necessary to comply with Section 7.038, Education |
|---|
| 96 | 96 | | Code, as added by this Act. |
|---|
| 97 | 97 | | SECTION 3. This Act takes effect September 1, 2025. |
