1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13- SECTION 1. Chapter 301, Labor Code, is amended by adding
14- Subchapter L to read as follows:
15- SUBCHAPTER L. PREVENTION, DETECTION, AND INVESTIGATION OF FRAUD,
16- WASTE, AND ABUSE IN COMMISSION PROGRAMS
17- Sec. 301.201. PREVENTION, DETECTION, AND INVESTIGATION OF
18- FRAUD, WASTE, AND ABUSE. (a) The commission shall develop:
19- (1) procedures to prevent, detect, and investigate
20- fraud, waste, and abuse in programs administered:
21- (A) by the commission;
22- (B) under contract with the commission; or
23- (C) by a person awarded a grant by the
24- commission;
25- (2) systems to detect fraud, waste, and abuse in the
26- administration, provision, and delivery of programs described by
27- Subdivision (1); and
28- (3) methods for a person to report to the commission
29- fraud, waste, or abuse in the delivery of the programs described by
30- Subdivision (1), including an option for reporting through the
31- commission's publicly available Internet website.
11+ SECTION 1. The heading to Texas Labor Code, Chapter 301,
12+ Subchapter K, is amended to read as follows:
13+ SUBCHAPTER K. PREVENTION, DETECTION AND, INVESTIGATION
14+ PREVENTION OF CHILD CARE FRAUD, WASTE AND ABUSE; SPECIAL PROVISIONS
15+ FOR CHILD CARE FRAUD
16+ SECTION 2. Chapter 301, Subchapter K, Labor Code, is
17+ amended by adding Section 301.190 to read as follows:
18+ Sec. 301.190. PREVENTION, DETECTION AND INVESTIGATION OF
19+ FRAUD, WASTE, AND ABUSE IN COMMISSION PROGRAMS. (a) The commission
20+ shall develop procedures to prevent, detect, and investigate,
21+ fraud, waste, and abuse in all programs administered by the
22+ commission, or its subrecipients, and any contractors of either.
23+ Additionally, the commission shall develop:
24+ (1) systems to detect fraud, waste, and abuse in the
25+ administration, provision, and delivery of all programs and
26+ services;
27+ (2) a method to report fraud, waste, and abuse on the
28+ commission's public Internet site; and
29+ (3) a method for the commission's subrecipients, and
30+ the contractors of the commission and its subrecipients, to report
31+ fraud, waste, and abuse related to the programs they administer on
32+ behalf of the commission.
3233 (b) The commission may obtain any information or technology
33- necessary to enable the commission to meet its responsibilities
34- under this subchapter or other law in regard to the prevention,
35- detection, and investigation of fraud, waste, and abuse in
36- commission programs.
37- SECTION 2. This Act takes effect September 1, 2025.
