77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the prohibited prescription, delivery, administration,
1010 use, advertisement, and solicitation of a COVID-19 vaccine
1111 containing mRNA material.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 161, Health and Safety
1414 Code, is amended by adding Section 161.0086 to read as follows:
1515 Sec. 161.0086. PROHIBITED PRESCRIPTION, DELIVERY,
1616 ADMINISTRATION, OR USE OF COVID-19 VACCINE CONTAINING MRNA
1717 MATERIAL. (a) In this section:
1818 (1) "COVID-19" means the 2019 novel coronavirus
1919 disease.
2020 (2) "mRNA material" means a substance that introduces
2121 messenger ribonucleic acid (mRNA) corresponding to a viral protein.
2222 (b) A person may not prescribe, deliver, administer, or use
2323 a vaccine intended to prevent COVID-19 if the vaccine contains mRNA
2424 material.
2525 SECTION 2. Subchapter B, Chapter 431, Health and Safety
2626 Code, is amended by adding Section 431.0215 to read as follows:
2727 Sec. 431.0215. ADDITIONAL PROHIBITED ACTS. (a) In this
2828 section:
2929 (1) "COVID-19" means the 2019 novel coronavirus
3030 disease.
3131 (2) "mRNA material" means a substance that introduces
3232 messenger ribonucleic acid (mRNA) corresponding to a viral protein.
3333 (b) A person may not advertise or solicit patients for
3434 immunization with a COVID-19 vaccine containing mRNA material.
3535 SECTION 3. This Act takes effect September 1, 2025.
