| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 161, Health and Safety |
|---|
| 14 | 14 | | Code, is amended by adding Section 161.0086 to read as follows: |
|---|
| 15 | 15 | | Sec. 161.0086. PROHIBITED PRESCRIPTION, DELIVERY, |
|---|
| 16 | 16 | | ADMINISTRATION, OR USE OF COVID-19 VACCINE CONTAINING MRNA |
|---|
| 17 | 17 | | MATERIAL. (a) In this section: |
|---|
| 18 | 18 | | (1) "COVID-19" means the 2019 novel coronavirus |
|---|
| 19 | 19 | | disease. |
|---|
| 20 | 20 | | (2) "mRNA material" means a substance that introduces |
|---|
| 21 | 21 | | messenger ribonucleic acid (mRNA) corresponding to a viral protein. |
|---|
| 22 | 22 | | (b) A person may not prescribe, deliver, administer, or use |
|---|
| 23 | 23 | | a vaccine intended to prevent COVID-19 if the vaccine contains mRNA |
|---|
| 24 | 24 | | material. |

| 25 | 25 | | SECTION 2. Subchapter B, Chapter 431, Health and Safety |
|---|
| 26 | 26 | | Code, is amended by adding Section 431.0215 to read as follows: |

| 27 | 27 | | Sec. 431.0215. ADDITIONAL PROHIBITED ACTS. (a) In this |
|---|
| 28 | 28 | | section: |
|---|
| 29 | 29 | | (1) "COVID-19" means the 2019 novel coronavirus |

|---|
| 31 | 31 | | (2) "mRNA material" means a substance that introduces |

| 32 | 32 | | messenger ribonucleic acid (mRNA) corresponding to a viral protein. |

| 33 | 33 | | (b) A person may not advertise or solicit patients for |
|---|
| 34 | 34 | | immunization with a COVID-19 vaccine containing mRNA material. |

| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2025. |
