8	8	AN ACT
9	9	relating to the transfer of certain state property from the Texas
10	10	Department of Criminal Justice to Walker County.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. (a) As soon as practicable, the Texas Department
13	13	of Criminal Justice shall transfer to Walker County the real
14	14	property interests of the State of Texas and the department in the
15	15	tract of land described by Subsection (f) of this section.
16	16	(b) Walker County may use the property transferred under
17	17	this Act only for a justice center. If Walker County uses the
18	18	property for any purpose other than the purpose described by this
19	19	subsection or if Walker County fails to use the property for the
20	20	purpose described by this subsection before the 10th anniversary of
21	21	the date of transfer, ownership of the property automatically
22	22	reverts to the Texas Department of Criminal Justice.
23	23	(c) The Texas Department of Criminal Justice shall transfer
24	24	the property by an appropriate instrument of transfer. The
25	25	instrument of transfer must:
26	26	(1) provide that:
27	27	(A) Walker County may use the property only for a
28	28	justice center; and
29	29	(B) ownership of the property will automatically
30	30	revert to the Texas Department of Criminal Justice if Walker
31	31	County:
32	32	(i) uses the property for any purpose other
33	33	than the purpose described by Paragraph (A) of this subdivision; or
34	34	(ii) fails to use the property for the
35	35	purpose described by Paragraph (A) of this subdivision before the
36	36	10th anniversary of the date of the transfer; and
37	37	(2) describe the property to be transferred by metes
38	38	and bounds.
39	39	(d) The Texas Department of Criminal Justice shall retain
40	40	custody of the instrument of transfer after the instrument of
41	41	transfer is filed in the real property records of Walker County.
42	42	(e) Sections 31.158 and 31.159, Natural Resources Code, do
43	43	not apply to the transfer of real property authorized by this Act.
44	44	(f) The tract of land referred to in this section is
45	45	described as follows:
46	46	State of Texas 14.999 Acres
47	47	County of WALKER
48	48	EXHIBIT "A"
49	49	Field notes of a 14.999 acres (653,371 sq. ft.)out of a called
50	50	279.39 acres, lying and being situated in the P. Gray League, A-24,
51	51	Walker County, being the same land described in Volume 112, Page 52
52	52	of the Official Records of Walker County, Texas and being more
53	53	particularly described herein;
54	54	Beginning at a concrete monument found in the south margin of a 100'
55	55	wide road (FM 2821), being the east margin of a variable width
56	56	county road (Smith Hill Road), marking the northwest corner and
57	57	point of beginning of the herein described 14.999 acres;
58	58	Thence N 60°21'13" E, along and with the south margin of FM 2821 , a
59	59	distance of 159.94 feet to a concrete monument found, marking an
60	60	interior corner of the herein described 14.999 acres;
61	61	Thence continuing along and with the south margin of FM 2821 with a
62	62	curve to the right having a radius of 3780.30 feet, an arc length of
63	63	745.28, with a chord bearing of N 81°11'59" E , and a chord distance
64	64	of 744.07 feet to a concrete monument found for an interior corner
65	65	of the herein described 14.999 acres;
66	66	Thence N 86°58'17" E, continuing along and with the south margin of
67	67	FM 2821, a distance of 182.83 feet to a 1/2" iron rod set marked
68	68	"Campbell - Sandoval" from which a concrete monument found bears N
69	69	86°58'19" E, a distance of 557.10 feet marking the northeast corner
70	70	of the herein described 14.999 acres;
71	71	Thence S 03°53'37" E, departing the south margin of FM 2821, cutting
72	72	across and through the called 279.39 acre parent tract, a distance
73	73	of 634.00 feet to a 1/2" iron rod set marked "Campbell - Sandoval",
74	74	marking the southeast corner of the herein described 14.999 acres;
75	75	Thence S 85°53'14" W, cutting across and through the called 279.39
76	76	acre parent tract , a distance of 1067.85 feet to a 1/2" iron rod set
77	77	marked "Campbell - Sandoval" from which a 1/2" iron rod found bears
78	78	S 03°56'02" E, a distance of 121.33 feet, said point being in the
79	79	east margin of the aforementioned Smith Hill Road, marking the
80	80	southwest corner of the herein described 14.999 acres;
81	81	Thence N 03°56'02" W, along and with the east margin of Smith Hill
82	82	Road, a distance of 507.71 feet back to point of beginning and
83	83	containing 14.999 acres.
84	84	SECTION 2. This Act takes effect immediately if it receives
85	85	a vote of two-thirds of all the members elected to each house, as
86	86	provided by Section 39, Article III, Texas Constitution. If this
87	87	Act does not receive the vote necessary for immediate effect, this
88	88	Act takes effect September 1, 2025.
