77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the transfer of certain state property from the Texas
1010 Department of Criminal Justice to Walker County.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) As soon as practicable, the Texas Department
1313 of Criminal Justice shall transfer to Walker County the real
1414 property interests of the State of Texas and the department in the
1515 tract of land described by Subsection (f) of this section.
1616 (b) Walker County may use the property transferred under
1717 this Act only for a justice center. If Walker County uses the
1818 property for any purpose other than the purpose described by this
1919 subsection or if Walker County fails to use the property for the
2020 purpose described by this subsection before the 10th anniversary of
2121 the date of transfer, ownership of the property automatically
2222 reverts to the Texas Department of Criminal Justice.
2323 (c) The Texas Department of Criminal Justice shall transfer
2424 the property by an appropriate instrument of transfer. The
2525 instrument of transfer must:
2626 (1) provide that:
2727 (A) Walker County may use the property only for a
2828 justice center; and
2929 (B) ownership of the property will automatically
3030 revert to the Texas Department of Criminal Justice if Walker
3131 County:
3232 (i) uses the property for any purpose other
3333 than the purpose described by Paragraph (A) of this subdivision; or
3434 (ii) fails to use the property for the
3535 purpose described by Paragraph (A) of this subdivision before the
3636 10th anniversary of the date of the transfer; and
3737 (2) describe the property to be transferred by metes
3838 and bounds.
3939 (d) The Texas Department of Criminal Justice shall retain
4040 custody of the instrument of transfer after the instrument of
4141 transfer is filed in the real property records of Walker County.
4242 (e) Sections 31.158 and 31.159, Natural Resources Code, do
4343 not apply to the transfer of real property authorized by this Act.
4444 (f) The tract of land referred to in this section is
4545 described as follows:

4949 Field notes of a 14.999 acres (653,371 sq. ft.)out of a called
5050 279.39 acres, lying and being situated in the P. Gray League, A-24,
5151 Walker County, being the same land described in Volume 112, Page 52
5252 of the Official Records of Walker County, Texas and being more
5353 particularly described herein;
5454 Beginning at a concrete monument found in the south margin of a 100'
5555 wide road (FM 2821), being the east margin of a variable width
5656 county road (Smith Hill Road), marking the northwest corner and
5757 point of beginning of the herein described 14.999 acres;
5858 Thence N 60°21'13" E, along and with the south margin of FM 2821 , a
5959 distance of 159.94 feet to a concrete monument found, marking an
6060 interior corner of the herein described 14.999 acres;
6161 Thence continuing along and with the south margin of FM 2821 with a
6262 curve to the right having a radius of 3780.30 feet, an arc length of
6363 745.28, with a chord bearing of N 81°11'59" E , and a chord distance
6464 of 744.07 feet to a concrete monument found for an interior corner
6565 of the herein described 14.999 acres;
6666 Thence N 86°58'17" E, continuing along and with the south margin of
6767 FM 2821, a distance of 182.83 feet to a 1/2" iron rod set marked
6868 "Campbell - Sandoval" from which a concrete monument found bears N
6969 86°58'19" E, a distance of 557.10 feet marking the northeast corner
7070 of the herein described 14.999 acres;
7171 Thence S 03°53'37" E, departing the south margin of FM 2821, cutting
7272 across and through the called 279.39 acre parent tract, a distance
7373 of 634.00 feet to a 1/2" iron rod set marked "Campbell - Sandoval",
7474 marking the southeast corner of the herein described 14.999 acres;
7575 Thence S 85°53'14" W, cutting across and through the called 279.39
7676 acre parent tract , a distance of 1067.85 feet to a 1/2" iron rod set
7777 marked "Campbell - Sandoval" from which a 1/2" iron rod found bears
7878 S 03°56'02" E, a distance of 121.33 feet, said point being in the
7979 east margin of the aforementioned Smith Hill Road, marking the
8080 southwest corner of the herein described 14.999 acres;
8181 Thence N 03°56'02" W, along and with the east margin of Smith Hill
8282 Road, a distance of 507.71 feet back to point of beginning and
8383 containing 14.999 acres.
8484 SECTION 2. This Act takes effect immediately if it receives
8585 a vote of two-thirds of all the members elected to each house, as
8686 provided by Section 39, Article III, Texas Constitution. If this
8787 Act does not receive the vote necessary for immediate effect, this
8888 Act takes effect September 1, 2025.
