9	8		AN ACT
10	9		relating to board of directors meeting locations of certain special
11	10		districts.
12	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	12		SECTION 1. Section 49.062(b-1), Water Code, is amended to
14	13		read as follows:
15	14		(b-1) If the board of [In this subsection, "rural area
16	15		district" means] a district in which more than half of the
17	16		district's projected retail water or sewer connections are active
18	17		[and that is not wholly or partly located in a county that as of the
19	18		2010 Census had a population of 800,000 or more or bordered a county
20	19		with a population of 800,000 or more. If the board of a rural area
21	20		district] conducts meetings at least quarterly, the board shall
22	21		conduct a meeting at least once per quarter:
23	22		(1) at a designated meeting location:
24	23		(A) inside the district;
25	24		(B) [or] within 10 miles of the boundary of the
26	25		district; or
27	26		(C) if [at least once per quarter. If] the board
28	27		determines that it is not practical to meet inside the district or
29	28		within 10 miles of the boundary of the district, [the district may
30	29		conduct the quarterly meeting] at another designated meeting place
31	30		in the county in which the district is located; or
32	31		(2) by telephone conference call or video conference
33	32		call, as provided by Section 49.064(b).
34	33		SECTION 2. Section 49.064, Water Code, is amended to read as
35	34		follows:
36	35		Sec. 49.064. MEETINGS. (a) The board shall hold such
37	36		regular and special meetings as may be necessary for the proper
38	37		conduct of the district's business. Except as provided by
39	38		Subsection (b), all [All] meetings shall be conducted in accordance
40	39		with [the open meetings law,] Chapter 551, Government Code. A
41	40		meeting of a committee of the board, or a committee composed of
42	41		representatives of more than one board, where less than a quorum of
43	42		any one board is present is not subject to the provisions of [the
44	43		open meetings law,] Chapter 551, Government Code.
45	44		(b) Notwithstanding Chapter 551, Government Code, the board
46	45		may hold a regular or special meeting by telephone conference call
47	46		or video conference call if at least one board member participating
48	47		in the meeting is physically present at a location that is open to
49	48		the public during the open portions of the meeting. A board member
50	49		who participates in a meeting by telephone conference call or video
51	50		conference call shall be counted as present at the meeting for all
52	51		purposes.
53	52		SECTION 3. Subchapter G, Chapter 54, Water Code, is amended
54	53		by adding Section 54.6015 to read as follows:
55	54		Sec. 54.6015. PUBLIC HEARING TO CONSIDER ADOPTION OF TAX
56	55		RATE. A public hearing at which the adoption of a tax rate will be
57	56		considered must be conducted:
58	57		(1) at a designated meeting location:
59	58		(A) inside the district; or
60	59		(B) within 10 miles of the boundary of the
61	60		district; or
62	61		(2) by telephone conference call or video conference
63	62		call, as provided by Section 49.064(b).
64	63		SECTION 4. This Act takes effect September 1, 2025.
