98 AN ACT
109 relating to board of directors meeting locations of certain special
1110 districts.
1211 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1312 SECTION 1. Section 49.062(b-1), Water Code, is amended to
1413 read as follows:
1514 (b-1) If the board of [In this subsection, "rural area
1615 district" means] a district in which more than half of the
1716 district's projected retail water or sewer connections are active
1817 [and that is not wholly or partly located in a county that as of the
1918 2010 Census had a population of 800,000 or more or bordered a county
2019 with a population of 800,000 or more. If the board of a rural area
2120 district] conducts meetings at least quarterly, the board shall
2221 conduct a meeting at least once per quarter:
2322 (1) at a designated meeting location:
2423 (A) inside the district;
2524 (B) [or] within 10 miles of the boundary of the
2625 district; or
2726 (C) if [at least once per quarter. If] the board
2827 determines that it is not practical to meet inside the district or
2928 within 10 miles of the boundary of the district, [the district may
3029 conduct the quarterly meeting] at another designated meeting place
3130 in the county in which the district is located; or
3231 (2) by telephone conference call or video conference
3332 call, as provided by Section 49.064(b).
3433 SECTION 2. Section 49.064, Water Code, is amended to read as
3534 follows:
3635 Sec. 49.064. MEETINGS. (a) The board shall hold such
3736 regular and special meetings as may be necessary for the proper
3837 conduct of the district's business. Except as provided by
3938 Subsection (b), all [All] meetings shall be conducted in accordance
4039 with [the open meetings law,] Chapter 551, Government Code. A
4140 meeting of a committee of the board, or a committee composed of
4241 representatives of more than one board, where less than a quorum of
4342 any one board is present is not subject to the provisions of [the
4443 open meetings law,] Chapter 551, Government Code.
4544 (b) Notwithstanding Chapter 551, Government Code, the board
4645 may hold a regular or special meeting by telephone conference call
4746 or video conference call if at least one board member participating
4847 in the meeting is physically present at a location that is open to
4948 the public during the open portions of the meeting. A board member
5049 who participates in a meeting by telephone conference call or video
5150 conference call shall be counted as present at the meeting for all
5251 purposes.
5352 SECTION 3. Subchapter G, Chapter 54, Water Code, is amended
5453 by adding Section 54.6015 to read as follows:
5554 Sec. 54.6015. PUBLIC HEARING TO CONSIDER ADOPTION OF TAX
5655 RATE. A public hearing at which the adoption of a tax rate will be
5756 considered must be conducted:
5857 (1) at a designated meeting location:
5958 (A) inside the district; or
6059 (B) within 10 miles of the boundary of the
6160 district; or
6261 (2) by telephone conference call or video conference
6362 call, as provided by Section 49.064(b).
6463 SECTION 4. This Act takes effect September 1, 2025.
