77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study by the broadband development office on Internet
1010 service for multiunit residential properties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. DEFINITIONS. In this Act:
1313 (1) "Broadband service" means Internet service with
1414 the capability of providing:
1515 (A) a speed of not less than 100 megabits per
1616 second for a download;
1717 (B) a speed of not less than 20 megabits per
1818 second for an upload; and
1919 (C) a network round-trip latency of less than or
2020 equal to 100 milliseconds based on the 95th percentile of speed
2121 measurements.
2222 (2) "Multiunit residential property" means improved
2323 real property with at least 75 dwelling units, including an
2424 apartment building or condominium. The term does not include a
2525 hotel, motel, single-family home, or duplex.
2626 (3) "Office" means the broadband development office.
2727 SECTION 2. STUDY ON BROADBAND ACCESS FOR MULTIUNIT
2828 RESIDENTIAL PROPERTIES. (a) The office shall conduct a study on
2929 the availability of access to Internet service for residents of
3030 multiunit residential properties in this state.
3131 (b) The study must:
3232 (1) identify areas that lack physical infrastructure
3333 necessary for the provision of broadband service for multiunit
3434 residential properties;
3535 (2) compare:
3636 (A) the number of broadband service providers
3737 that serve multiunit residential properties in urban areas to the
3838 number that serve single-family homes in urban areas; and
3939 (B) average internet speeds available in urban
4040 areas to multiunit residential properties and to single-family
4141 homes;
4242 (3) estimate the average cost of broadband service in
4343 multiunit residential properties in urban areas;
4444 (4) determine the percentage of multiunit residential
4545 properties in urban areas that have access to Internet service
4646 providers that are capable of providing reliable broadband service;
4747 (5) assess Internet service downtime and consistency
4848 of Internet speeds for multiunit residential properties;
4949 (6) assess the availability and usage of broadband
5050 affordability programs for multiunit residential properties in
5151 urban areas;
5252 (7) assess the effects for tenants of a multiunit
5353 residential property of the property owner entering into an
5454 exclusive contract with an Internet service provider for the entire
5555 property, including effects on service costs;
5656 (8) assess the effects of municipal regulations and an
5757 absence of municipal regulations on broadband service
5858 infrastructure deployment in areas with a high concentration of
5959 multiunit residential properties; and
6060 (9) where possible, include an assessment of whether
6161 the factors described above differ in low-income areas and
6262 higher-income areas.
6363 SECTION 3. REPORT TO THE LEGISLATURE. Not later than
6464 December 1, 2026, the office shall submit to the governor, the
6565 lieutenant governor, the speaker of the house of representatives,
6666 and each standing committee of the legislature with jurisdiction
6767 over broadband service a report that includes the results of the
6868 study and any recommendations of the office related to the study.
6969 SECTION 4. EXPIRATION. This Act expires September 1, 2027.
7070 SECTION 5. EFFECTIVE DATE. This Act takes effect September
7171 1, 2025.
