| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 2.025(d), Election Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (d) A runoff election for a special election [to fill a |
|---|
| 15 | 15 | | vacancy in Congress or a special election to fill a vacancy in the |
|---|
| 16 | 16 | | legislature], except an election ordered as an emergency election |
|---|
| 17 | 17 | | under Section 41.0011 or an election held as an expedited election |
|---|
| 18 | 18 | | under Section 203.013, shall be held not [earlier than the 70th day |
|---|
| 19 | 19 | | or] later than the 30th [77th] day after the date the final canvass |
|---|
| 20 | 20 | | of the main election is completed. |
|---|
| 21 | 21 | | SECTION 2. Section 41.007(b), Election Code, is amended to |
|---|
| 22 | 22 | | read as follows: |
|---|
| 23 | 23 | | (b) The runoff primary election date is the fourth Tuesday |
|---|
| 24 | 24 | | [in May] following the general primary election. |
|---|
| 25 | 25 | | SECTION 3. Section 203.004(a), Election Code, is amended to |
|---|
| 26 | 26 | | read as follows: |
|---|
| 27 | 27 | | (a) Except as provided by Subsection (b), a special election |
|---|
| 28 | 28 | | shall be held not later than the 90th day after the date the vacancy |
|---|
| 29 | 29 | | occurs, unless the vacancy occurs on or after the 120th day before |
|---|
| 30 | 30 | | and not later than the 36th day before the date of the next uniform |
|---|
| 31 | 31 | | election date, in which case the special election shall be held on |
|---|
| 32 | 32 | | the first uniform election date occurring on or after the 36th day |
|---|
| 33 | 33 | | after the date the election is ordered. |
|---|
| 34 | 34 | | SECTION 4. This Act applies only to an election ordered on |
|---|
| 35 | 35 | | or after the effective date of this Act. |
|---|
| 36 | 36 | | SECTION 5. This Act takes effect September 1, 2025. |
