99 relating to a school district's library collection development
1010 policies; authorizing a civil penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 33.021, Education Code,
1313 is amended to read as follows:
1414 Sec. 33.021. LIBRARY STANDARDS; CIVIL PENALTY.
1515 SECTION 2. Section 33.021, Education Code, is amended by
1616 adding Subsection (e) to read as follows:
1717 (e) Not later than the 30th day after the date a school
1818 district is notified that a library material found in a school
1919 library, classroom library, or online catalog does not adhere to
2020 the standards adopted under Subsection (c), the district shall
2121 remove the material. A superintendent of a school district that
2222 does not remove a library material as required by this subsection is
2323 liable to the state for a civil penalty in an amount not to exceed
2424 $10,000 for each violation. A person commits a separate violation
2525 for each library material that is not removed in violation of this
2626 subsection except multiple copies of the same library material do
2727 not constitute separate violations. The attorney general may
2828 investigate any alleged violation of this section and may bring an
2929 action to recover the civil penalty described by this subsection.
3030 SECTION 3. This Act applies beginning with the 2025-2026
3131 school year.
3232 SECTION 4. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2025.
