| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. The heading to Section 33.021, Education Code, |
|---|
| 13 | 13 | | is amended to read as follows: |
|---|
| 14 | 14 | | Sec. 33.021. LIBRARY STANDARDS; CIVIL PENALTY. |
|---|
| 15 | 15 | | SECTION 2. Section 33.021, Education Code, is amended by |
|---|
| 16 | 16 | | adding Subsection (e) to read as follows: |
|---|
| 17 | 17 | | (e) Not later than the 30th day after the date a school |
|---|
| 18 | 18 | | district is notified that a library material found in a school |
|---|
| 19 | 19 | | library, classroom library, or online catalog does not adhere to |
|---|
| 20 | 20 | | the standards adopted under Subsection (c), the district shall |
|---|
| 21 | 21 | | remove the material. A superintendent of a school district that |
|---|
| 22 | 22 | | does not remove a library material as required by this subsection is |
|---|
| 23 | 23 | | liable to the state for a civil penalty in an amount not to exceed |
|---|
| 24 | 24 | | $10,000 for each violation. A person commits a separate violation |
|---|
| 25 | 25 | | for each library material that is not removed in violation of this |
|---|
| 26 | 26 | | subsection except multiple copies of the same library material do |
|---|
| 27 | 27 | | not constitute separate violations. The attorney general may |
|---|
| 28 | 28 | | investigate any alleged violation of this section and may bring an |
|---|
| 29 | 29 | | action to recover the civil penalty described by this subsection. |
|---|
| 30 | 30 | | SECTION 3. This Act applies beginning with the 2025-2026 |
|---|
| 31 | 31 | | school year. |
|---|
| 32 | 32 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2025. |
