99 relating to the meeting places for the board of directors of certain
1010 special districts.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 49, Water Code, is amended
1313 by adding Section 49.0621 to read as follows:
1414 Sec. 49.0621. MEETING PLACES FOR BOARD OF CERTAIN
1515 DISTRICTS. (a) This section applies only to a district wholly or
1616 partly located in a county that:
1717 (1) contains a portion of the Cedar Creek Reservoir;
1818 and
1919 (2) borders a county with a population of 2.6 million
2020 or more.
2121 (b) Notwithstanding Section 49.062, if the board of a
2222 district to which this section applies conducts meetings at least
2323 quarterly, the board shall conduct a meeting at least once per
2424 quarter at a designated meeting location:
2525 (1) inside the district; or
2626 (2) within 10 miles of the boundary of the district.
2727 (c) Notwithstanding Section 49.064 or Chapter 551,
2828 Government Code, the board of a district to which this section
2929 applies may hold a regular or special meeting by telephone
3030 conference call or video conference call if at least one board
3131 member participating in the meeting is physically present at a
3232 location that is open to the public during the open portions of the
3333 meeting. A board member who participates in a meeting by telephone
3434 conference call or video conference call shall be counted as
3535 present at the meeting for all purposes.
3636 SECTION 2. Subchapter G, Chapter 54, Water Code, is amended
3737 by adding Section 54.6015 to read as follows:
3838 Sec. 54.6015. PUBLIC HEARING TO CONSIDER ADOPTION OF TAX
3939 RATE FOR CERTAIN DISTRICTS. (a) This section applies only to a
4040 district wholly or partly located in a county described by Section
4141 49.0621(a).
4242 (b) A public hearing at which the adoption of a tax rate will
4343 be considered must be conducted:
4444 (1) at a designated meeting location:
4545 (A) inside the district; or
4646 (B) within 10 miles of the boundary of the
4747 district; or
4848 (2) by telephone conference call or video conference
4949 call, as provided by Section 49.0621(c).
5050 SECTION 3. This Act takes effect September 1, 2025.
