10	8		AN ACT
11	9		relating to critical infrastructure facility emergency response
12	10		maps and the critical infrastructure emergency response map grant
13	11		program.
14	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	13		SECTION 1. Chapter 424, Government Code, is amended by
16	14		adding Subchapter D to read as follows:
17	15		SUBCHAPTER D. EMERGENCY RESPONSE MAP AND GRANT PROGRAM
18	16		Sec. 424.151. DEFINITIONS. In this subchapter:
19	17		(1) "Department" means the Department of Public Safety
20	18		of the State of Texas.
21	19		(2) "Fund" means the critical infrastructure
22		-	emergency response map fund created under Section 424.~~155~~.

23	21		(3) "Grant program" means the critical infrastructure
24	22		emergency response map grant program established under Section
25		-	424.~~154~~.

26	24		(4) "Public safety agency" and "public safety
27	25		answering point" have the meanings assigned by Section 771.001,
28	26		Health and Safety Code.
29		-	Sec. 424.152. APPLICABILITY. This subchapter applies only
30		-	to a critical infrastructure facility that is:
31		-	(1) a public or private airport depicted in any
32		-	current aeronautical chart published by the Federal Aviation
33		-	Administration; or
34		-	(2) a military installation owned or operated by or
35		-	for the federal government, this state, or another governmental
36		-	entity.
37		-	Sec. 424.153. EMERGENCY RESPONSE MAP AND TOUR. (a) Each
38		-	critical infrastructure facility to which this subchapter applies
39		-	shall provide to the department and appropriate public safety
40		-	agencies:

	28	+	critical infrastructure facility shall provide to the department
	29	+	and appropriate public safety agencies:
41	30		(1) an accurate emergency response map of the facility
42	31		that is developed in accordance with the standards described by
43	32		Subsection (b); and
44	33		(2) an opportunity to tour the facility using the map
45	34		described by Subdivision (1) to verify the map's accuracy.
46	35		(b) An emergency response map must:
47	36		(1) include:
48	37		(A) an accurate floor plan overlaid on current,
49	38		verified aerial imagery of the facility and its surrounding land
50	39		and a site-specific label for each building of the facility;
51	40		(B) a label for each:
52	41		(i) room;
53	42		(ii) named hallway; and
54	43		(iii) external door or stairwell number;
55	44		and
56	45		(C) the location of each:
57	46		(i) known hazard;
58	47		(ii) critical utility;
59	48		(iii) key box;
60	49		(iv) automated external defibrillator; and
61	50		(v) trauma kit;
62	51		(2) conform to, integrate with, and be accessible by
63	52		software used by the department, entities operating a local public
64	53		safety answering point, or appropriate public safety agencies
65	54		without imposing a fee or requiring the purchase of additional
66	55		software to access the map and associated data;
67	56		(3) be in a format capable of being printed, shared
68	57		electronically, or integrated into an interactive software
69	58		application; and
70	59		(4) be in a format easily modified or updated.
71		-	(c) A critical infrastructure facility to which this
72		-	subchapter applies may only provide an emergency response map to
73		-	the department and appropriate public safety agencies for purposes
74		-	of developing a verified source of critical infrastructure mapping
75		-	data in this state and ensuring efficient emergency response for
76		-	the facility.
77		-	(d) A critical infrastructure facility to which this
78		-	subchapter applies may not provide or make available to the public
79		-	an emergency response map.
80		-	Sec. 424.154. CRITICAL INFRASTRUCTURE EMERGENCY RESPONSE
	60	+	(c) A critical infrastructure facility may only provide an
	61	+	emergency response map to the department and appropriate public
	62	+	safety agencies for purposes of developing a verified source of
	63	+	critical infrastructure mapping data in this state and ensuring
	64	+	efficient emergency response for the facility.
	65	+	(d) A critical infrastructure facility may not provide or
	66	+	make available to the public an emergency response map.
	67	+	Sec. 424.153. CRITICAL INFRASTRUCTURE EMERGENCY RESPONSE
81	68		MAP GRANT PROGRAM. (a) The department shall establish and
82	69		administer a grant program to provide mapping services for critical
83		-	infrastructure facilities to ~~which this subchapter applies to~~
84		-	~~develop emergency response maps~~ required under Section 424.~~153~~.

85	72		(b) A grant awarded under this section may only be used to
86	73		obtain mapping services for a critical infrastructure facility to
87		-	which this subchapter applies to provide the emergency response map

89	75		(c) A mapping service provider who is a recipient of grant
90	76		money shall provide an emergency response map to the critical
91	77		infrastructure facility, the department, and appropriate public
92	78		safety agencies and may only charge a fee for the initial production
93	79		cost for the map.
94	80		(d) The department shall adopt rules to administer the grant
95	81		program established under this section, including eligibility
96	82		standards and procedures for applying for a grant under this
97	83		section.
98	84		(e) The department may award a grant under the grant program
99	85		only in accordance with a contract between the department and a
100	86		grant recipient. The contract must include provisions under which
101	87		the department is granted sufficient control to ensure the public
102	88		purpose of providing emergency response mapping services to
103		-	critical infrastructure facilities ~~to which this subchapter~~
104		-	~~applies is accomplished and the state~~ receives a return benefit.

106	92		MAP FUND. (a) The critical infrastructure emergency response map
107	93		fund is a dedicated account in the general revenue fund
108	94		administered by the department.
109	95		(b) The fund consists of:
110	96		(1) legislative appropriations of money to the
111	97		department for deposit to the credit of the fund for purposes of
112	98		this subchapter;
113	99		(2) any revenue that by law is dedicated for deposit to
114	100		the fund;
115	101		(3) interest or other earnings on money credited to or
116	102		allocable to the fund; and
117	103		(4) gifts, grants, including federal grants, or
118	104		donations received by the department for the fund.
119	105		(c) Money in the fund may be appropriated only to the
120	106		department to administer the grant program and award grants under
121		-	Section 424.~~154~~.

122	108		SECTION 2. As soon as practicable after the effective date
123	109		of this Act, the Department of Public Safety of the State of Texas
124		-	shall establish the grant program required under Section 424.~~154~~,

125	111		Government Code, as added by this Act.
126	112		SECTION 3. This Act takes effect September 1, 2025.
