119 relating to critical infrastructure facility emergency response
1210 maps and the critical infrastructure emergency response map grant
1311 program.
1412 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1513 SECTION 1. Chapter 424, Government Code, is amended by
1614 adding Subchapter D to read as follows:
1715 SUBCHAPTER D. EMERGENCY RESPONSE MAP AND GRANT PROGRAM
1816 Sec. 424.151. DEFINITIONS. In this subchapter:
1917 (1) "Department" means the Department of Public Safety
2018 of the State of Texas.
2119 (2) "Fund" means the critical infrastructure
22- emergency response map fund created under Section 424.155.
20+ emergency response map fund created under Section 424.154.
2321 (3) "Grant program" means the critical infrastructure
2422 emergency response map grant program established under Section
25- 424.154.
23+ 424.153.
2624 (4) "Public safety agency" and "public safety
2725 answering point" have the meanings assigned by Section 771.001,
2826 Health and Safety Code.
29- Sec. 424.152. APPLICABILITY. This subchapter applies only
30- to a critical infrastructure facility that is:
31- (1) a public or private airport depicted in any
32- current aeronautical chart published by the Federal Aviation
33- Administration; or
34- (2) a military installation owned or operated by or
35- for the federal government, this state, or another governmental
36- entity.
37- Sec. 424.153. EMERGENCY RESPONSE MAP AND TOUR. (a) Each
38- critical infrastructure facility to which this subchapter applies
39- shall provide to the department and appropriate public safety
40- agencies:
27+ Sec. 424.152. EMERGENCY RESPONSE MAP AND TOUR. (a) Each
28+ critical infrastructure facility shall provide to the department
29+ and appropriate public safety agencies:
4130 (1) an accurate emergency response map of the facility
4231 that is developed in accordance with the standards described by
4332 Subsection (b); and
4433 (2) an opportunity to tour the facility using the map
4534 described by Subdivision (1) to verify the map's accuracy.
4635 (b) An emergency response map must:
4736 (1) include:
4837 (A) an accurate floor plan overlaid on current,
4938 verified aerial imagery of the facility and its surrounding land
5039 and a site-specific label for each building of the facility;
5140 (B) a label for each:
5241 (i) room;
5342 (ii) named hallway; and
5443 (iii) external door or stairwell number;
5544 and
5645 (C) the location of each:
5746 (i) known hazard;
5847 (ii) critical utility;
5948 (iii) key box;
6049 (iv) automated external defibrillator; and
6150 (v) trauma kit;
6251 (2) conform to, integrate with, and be accessible by
6352 software used by the department, entities operating a local public
6453 safety answering point, or appropriate public safety agencies
6554 without imposing a fee or requiring the purchase of additional
6655 software to access the map and associated data;
6756 (3) be in a format capable of being printed, shared
6857 electronically, or integrated into an interactive software
6958 application; and
7059 (4) be in a format easily modified or updated.
71- (c) A critical infrastructure facility to which this
72- subchapter applies may only provide an emergency response map to
73- the department and appropriate public safety agencies for purposes
74- of developing a verified source of critical infrastructure mapping
75- data in this state and ensuring efficient emergency response for
76- the facility.
77- (d) A critical infrastructure facility to which this
78- subchapter applies may not provide or make available to the public
79- an emergency response map.
80- Sec. 424.154. CRITICAL INFRASTRUCTURE EMERGENCY RESPONSE
60+ (c) A critical infrastructure facility may only provide an
61+ emergency response map to the department and appropriate public
62+ safety agencies for purposes of developing a verified source of
63+ critical infrastructure mapping data in this state and ensuring
64+ efficient emergency response for the facility.
65+ (d) A critical infrastructure facility may not provide or
66+ make available to the public an emergency response map.
67+ Sec. 424.153. CRITICAL INFRASTRUCTURE EMERGENCY RESPONSE
8168 MAP GRANT PROGRAM. (a) The department shall establish and
8269 administer a grant program to provide mapping services for critical
83- infrastructure facilities to which this subchapter applies to
84- develop emergency response maps required under Section 424.153.

8572 (b) A grant awarded under this section may only be used to
8673 obtain mapping services for a critical infrastructure facility to
87- which this subchapter applies to provide the emergency response map

8975 (c) A mapping service provider who is a recipient of grant
9076 money shall provide an emergency response map to the critical
9177 infrastructure facility, the department, and appropriate public
9278 safety agencies and may only charge a fee for the initial production
9379 cost for the map.
9480 (d) The department shall adopt rules to administer the grant
9581 program established under this section, including eligibility
9682 standards and procedures for applying for a grant under this
9783 section.
9884 (e) The department may award a grant under the grant program
9985 only in accordance with a contract between the department and a
10086 grant recipient. The contract must include provisions under which
10187 the department is granted sufficient control to ensure the public
10288 purpose of providing emergency response mapping services to
103- critical infrastructure facilities to which this subchapter
104- applies is accomplished and the state receives a return benefit.
105- Sec. 424.155. CRITICAL INFRASTRUCTURE EMERGENCY RESPONSE

10692 MAP FUND. (a) The critical infrastructure emergency response map
10793 fund is a dedicated account in the general revenue fund
10894 administered by the department.
10995 (b) The fund consists of:
11096 (1) legislative appropriations of money to the
11197 department for deposit to the credit of the fund for purposes of
11298 this subchapter;
11399 (2) any revenue that by law is dedicated for deposit to
114100 the fund;
115101 (3) interest or other earnings on money credited to or
116102 allocable to the fund; and
117103 (4) gifts, grants, including federal grants, or
118104 donations received by the department for the fund.
119105 (c) Money in the fund may be appropriated only to the
120106 department to administer the grant program and award grants under
121- Section 424.154.

122108 SECTION 2. As soon as practicable after the effective date
123109 of this Act, the Department of Public Safety of the State of Texas
124- shall establish the grant program required under Section 424.154,

126112 SECTION 3. This Act takes effect September 1, 2025.
