11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 48.052(a), Education Code, is amended to | |
13 | 13 | read as follows: | |
14 | 14 | (a) Notwithstanding Section 48.051, a school district that | |
15 | 15 | has fewer than 350 [130] students in average daily attendance shall | |
16 | 16 | be provided a basic allotment on the basis of 350 [130] students in | |
17 | 17 | average daily attendance if it offers a kindergarten through grade | |
18 | 18 | 12 program and has preceding or current year's average daily | |
19 | 19 | attendance of at least 90 students or is 30 miles or more by bus | |
20 | 20 | route from the nearest high school district. A district offering a | |
21 | 21 | kindergarten through grade 8 program whose preceding or current | |
22 | 22 | year's average daily attendance was at least 50 students or which is | |
23 | 23 | 30 miles or more by bus route from the nearest high school district | |
24 | 24 | shall be provided a basic allotment on the basis of 75 students in | |
25 | 25 | average daily attendance. An average daily attendance of 60 | |
26 | 26 | students shall be the basis of providing the basic allotment if a | |
27 | 27 | district offers a kindergarten through grade 6 program and has | |
28 | 28 | preceding or current year's average daily attendance of at least 40 | |
29 | 29 | students or is 30 miles or more by bus route from the nearest high | |
30 | 30 | school district. | |
31 | 31 | SECTION 2. This Act takes effect September 1, 2025. |
