| 12 | 12 | SECTION 1. Subchapter D, Chapter 91, Natural Resources | |
| 13 | 13 | Code, is amended by adding Section 91.118 to read as follows: | |
| 14 | 14 | Sec. 91.118. TERM OF COMMERCIAL SURFACE DISPOSAL FACILITY | |
| 15 | 15 | PERMIT. (a) In this section, "commercial surface disposal | |
| 16 | 16 | facility" has the meaning assigned by Section 91.116. | |
| 17 | 17 | (b) Unless otherwise provided by law, a permit for a | |
| 18 | 18 | commercial surface disposal facility is valid for a term of not more | |
| 19 | 19 | than 10 years. | |
| 20 | 20 | SECTION 2. The change in law made by this Act applies only | |
| 21 | 21 | to a permit issued by the Railroad Commission of Texas on or after | |
| 22 | 22 | the effective date of this Act. A permit issued before the | |
| 23 | 23 | effective date of this Act is governed by the law in effect on the | |
| 24 | 24 | date of issuance, and that law is continued in effect for that | |
| 25 | 25 | purpose. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2025. |
