1010 AN ACT
1111 relating to a requirement that the Department of Information
1212 Resources implement and develop a system and database to
1313 authenticate and track certain digital content.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter C, Chapter 2054, Government Code, is
1616 amended by adding Section 2054.0542 to read as follows:
1717 Sec. 2054.0542. CONTENT PROVENANCE SYSTEM. (a) In this
1818 section:
1919 (1) "Content" means any visual, audio, or audiovisual
2020 digital content.
2121 (2) "Content provenance" means information, in a
2222 format that is compliant with guidelines or specifications adopted
2323 by an established standards-setting body, including:
2424 (A) the origin of the content;
2525 (B) the content's modification history;
2626 (C) whether the content is wholly or partly
2727 synthetic content; and
2828 (D) if the content is synthetic, the name of the
2929 generative artificial intelligence provider whose generative
3030 artificial intelligence tool generated the synthetic content.
3131 (3) "Cryptographic hash database" means a secure
3232 repository for storing digital signatures or hashes generated from
3333 content that may be used to verify that the content has not been
3434 altered.
3535 (4) "Hash" means a cryptographic representation of an
3636 original piece of content.
3737 (5) "State website" means any state Internet website
3838 maintained by the department that is primarily used to disseminate
3939 information to the public.
4040 (b) The department shall implement and maintain a content
4141 provenance system to:
4242 (1) embed into each piece of content created and owned
4343 by the department and posted on a state website the content's
4444 content provenance; and
4545 (2) include a hash for each piece of content created
4646 and owned by the department and posted by the department on a state
4747 website and record the hash in a cryptographic hash database.
4848 (c) The content provenance system must be tamper-evident
4949 and readily verifiable by the general public through accessible
5050 online tools or interfaces.
5151 (d) The department may provide technical assistance to
5252 another state agency to assist the agency in implementing a content
5353 provenance system for the agency's content.
5454 SECTION 2. (a) The Department of Information Resources
5555 shall implement the content provenance system required by Section
5656 2054.0542, Government Code, as added by this Act, not later than
5757 September 1, 2026.
5858 (b) Section 2054.0542, Government Code, as added by this
5959 Act, applies only to content that is created and owned by the
6060 Department of Information Resources on or after the date the
6161 department implements the content provenance system required by
6262 that section under Subsection (a) of this section.
6363 SECTION 3. This Act takes effect September 1, 2025.
